    Denial

    I knew it would happen eventually. I received a denial for the purchaser of a PPT. I called the DROS hotline and gave them the DROS number and they told me that they automatically run the seller if the purchaser is denied. They gave me the NTN # and told me to write it on the original DROS paperwork and I was good to return the gun to the seller.

    My question is how do I handle the 4473? Do I just make a note in box 30c on the original 4473 with the NICS # or do I have to fill out a new 4473 with the sellers name and NICS number and staple them together?

    I just handed it back to the original owner as if it we're a gunsmith return...no 4473. I'm probably going to Leavenworth for admitting that though.

      No.

      You have to have the seller fill out a 4473. Remember, Federal law is not the same as state law and this is NOT gunsmithing. When the BATF come out for an audit, they will likely want to know what happened to the firearm. There is no waiting period, per CA, so you use the number that you were given for the background check.

        The firearm is being returned to the seller, so the seller needs to fill out a 4473.

        You do not staple them together, while related, each is separate. The denial needs to be filed separately and retained for 5 years, whereas the one for the seller will have to be retained for 20 years.

          Thank you. I figured as much. My thought process told me that the BATF would want to see a paper trail of the firearm and who has it now. The A&D book is a no brainer, The seller brought it in and he will take it out so I will put his name on the "D" side with the new 4473#.
