    Off Roster-Handgun Disposition

    If I have an off-roster handgun that was supposed to go to a peace officer, but didn't, how do I dispose of it if I choose to close my FFL sometime in the future? Technically, I already own it as the sole proprietor. Does it become my personal inventory as any other gun? Any thoughts?

    Well, if it's a gen 4 Glock or a HK VP9, you're gonna be able to make some money off a ppt!

      Sell it on gunbroker out of state. I don't believe off roster transfer directly to you as personal property. Others may be able to confirm or deny the sole proprietor loophole. I'm an LLC so it doesn't apply to me. Seems like an easy way to get off roster guns otherwise.

        Sole proprietor FFL are not exempt from the certified list. Sell it out of state or to a person who is exempt from the certified list.

        There might be some way when you close your business, but I doubt that the CA DOJ would go for that.

          this answered my question in another thread, but what if it was used while in possession of the dealer as a demo then would it still be considered new dealer sale?

            Used makes no difference. PPT is an exemption, used is not.

                No kidding.
                If all it took to get off-roster handguns in CA is an FFL and a business license... well... okay, maybe not something all of us would do, but the way some people seem to be like cockroaches closing shop then reopening under a different name 6 months later... ya, there'd be a TON more PPT off-roster available.

                    I'm sure they do, but I'm not trying to hide anything or do anything illegal, just want to make sure I don't. It's a listing on Gunbroker if need be.

                      Valid question,

                      iv had an ex-FFL owner contact me as he stated he was getting his CCW and his Local Law enforcement agency required that all firearms on his CCW list had to be registered to him.

                      He wants to use a few pistols that he retained after his FFL closed but they have never been registered to anyone and were just retained inventory...

                      He requested i performs he transaction as follows:

                      1. I accept the guns into my bounds book and put his FFL as the entity i received it.
                      2. i transfer the firearm to him personally as a dealer handgun sale

                      ^^^^ this won't work because the guns are off roster

                      i told him the only way it'd be possible is if

                      1. i perform a PPT from himself to himself

                      i told him i have no idea how that would play out.

                          I guess you know why he's an ex-FFL owner... assuming he ran his business like he's asking you to do things says enough. Not sure if he's an ex-FFL from 20+ years ago or just recently. 20+ years ago I can see him not necessarily being current on laws. If ex-FFL from the past few years then that's just bad (IMO).
