does anyone know if i have any recourse? i left several firearms at a gun store on consignment, the guns have sold months ago and the owner keeps putting me off, making excuses. then he said he had unexpected bills and he will send payment, another 2 weeks have passed since the date he promised payment. He wont return my calls now, and the lady who answers the phone there today asked for my email address and said he would email me(never happened) What can I do?

yes, well i moved out of cali to another state for work, i am really disappointed as i think i bought half the guns from there in the first place. i sold some of my ca legal firearms in the hopes of buying something better here as the gun laws are not as restrictive.
i would love to work with this guy to get payment arrangements, but its really hard when they wont return your calls, i posted in this section mainly because i didnt know if i had any recourse with whoever issues ffl licences.

First I would start with your consignment agreement and see what it says about time span for payment.
Second let him know in a firm but friendly manner that payment is due and you need a firm payment date.
Consignment money collected should be kept in a separate account and not be used for other expenses. That being said bad things happen even to business owners and perhaps this was an emergency.
Get a firm date on when payment will be available. If you are still not paid unfortunately the next step would be small claims.
Try first to find a solution as gentlemen, like I said maybe there has been some kind of emergency.

well i live 1000 miles away from there now, i guess could drive or fly back. thanks again for the responses(even the 8 ball one). and 8 ball guy, in your face i dont need a bullet button here or 10 round mags

july this year. i left some on consignment cause i had too many to fit in my safe and my moving truck was full. in hind sight i wish i would have kept them, they all sold within 2 weeks.Comment

It's kind of a last resort, but you would be surprised how effective a strongly worded letter from a legal firm can be. Once they realize that they can be on the hook not only for the money, but for damages and legal fees, suddenly their budget may free up.

It would seem to me that the whole pawn/consignment industry is highly regulated. If I were me I would ask him one question.
"Would it make it easier if I had your local police department stop by to help resolve this issue?"
I would ask that question because I would be giving him one last chance to make things right.
If that didn't work I would be talking to his local police department about filing charges. Possibly theft by embellishment or something. Realizing that getting the LEO's involved will likely lead to loss of his license and his lively hood I would forfeit much hope of ever seeing my money, but at that point I wouldn't care.
To be honest, from what you have said I suspect he is majorly addicted to something, should not be near firearms, and reporting him could ultimately save his life.Only slaves don't need guns
