    In home transfer.

    Hello all,
The wife's mom passed two weeks ago.
    Stepdad is fading.
Is there any FFL willing to or is it legal for a FFL to come to the house and do some transfers.
    This will be Stockton/Lodi area.
Need help sorting this all out.
    Thanks

Family transfers as far as I am aware from parent to child or husband to wife only requires a form and $19.

A FFL can not come to your house. They can only do transfers at their shop or a gun show.

Sorry for the loss in your family.

Your wife can fill out this form https://oag.ca.gov/sites/all/files/a...rms/oplaw.pdf? and mail it to DOJ. There is no need to have a FFL come to the house. She will need to get the Firearms Safety Card. That will require a visit to a gun shop.

The mother could have left the firearms to her daughter knowing that her husband was to unwell to inherent them.

              Some clearification.

An FFL cannot bring a 4473 to your fathers in law house and have him and you do the paperwork.

However the FFL can acquire weapons off premise. The law only says all paperwork must be done on premise. So the FFL can visit your father in law and acquire the gun, no paperwork can be done there.

You can then go into the FFL shop and do the paperwork as a dealer sale.

The FFL will need a second hand dealers license.

Any chance you can have stepdad do a trust and name your wife as the executrix of his estate then she can dispose of his firearms for him.

Wouldn't a power of attorney work where the owner is an invalid? The DOJ allowed me to have a friend of the family bring in a firearm with a POA and do a PPT for a man who was bedridden. This was a couple of years ago though.

A secondhand dealers permit is only needed when the FFL buys firearms for inventory, not for receiving firearms for transfer.

Yes, I believe it would when the firearms are coming from a person. Not sure about if the firearms were going to a person.

You are correct. I got caught up on an ffl acquiring firearms for sale anywhere and not just a transfer.

As noted, the best thing to do might be to try and get a trust put together. An attorney will be able to do that as a house call - it happens all the time. Might cost a few hundred bucks, but probably well worth it if the stepdad can't get out of bed....

Stepdad is not bed ridden. He's just not all there.
