    I had a customer that came in and wanted to know if they have a cannabis card would it stop them from getting firearm?

    Read this


    It says if you know the person has a medical marijuana card, you now have reason to believe they are prohibited and cannot transfer firearms or ammo to them, no matter how they answer 11e. So now you cannot transfer to that person.

        Ok so does that mean that the background will find out or if they habe one and answer no on 4473 and I don't believe they have one it's ok?

          It means follow the law. If you know or have any reason to believe someone you are about to transfer a firearm to is a user of marijuana, either because you can smell it on them, you have seen their card, or you saw them leave a dispensary, whatever the case - you do not transfer to them.

          I wouldn't worry about how it will be discovered by ATF or DOJ that the person was a user, I'd be more worried about not getting myself into a position to find out the hard way what happens if it is discovered.

            What I like to know cuz if ya I smell it or they look like it of course I won't and there so many laws to whwre if u suspect then no but when ppl come in 95% of them are good so then nothing for me to suspect anything

              However, if a potential buyer shows the card, the BATF memo says you DO have reason.

                  Wait until the NSA get the data on buyers from CA,WA,CO etc and adds them all into the federal prohibited list

                      Until that day the law is clear and had been explained to you. Personal feelings about the topic of a law have no bearing on your responsibility to enforce such law.

                      Also understand that it is not unheard of for ATF or DOJ to come to a shop undercover. Don't do something stupid and loose your license before the ink is dry on it.

                        One aspect to this is that many people answer the question without regard to Federal law. They incorrectly think that because they have a card that it is not illegal in CA, but it is.

                            I've talked to quite a few FFL's that mentioned someone trying to use a med marijuana card as proof of residency! On Target and Bullseye have signs saying how they deny service if you smell like marijuana. Wasn't their an opinion that it was like 5 years since last use than constitutes being an unlawful user?


                            South Park should do an episode where Towelie tries to fill out a 4473 at the local gun shop.

                              I don't know about the 5 year thing. If you are obviously intoxicated, if I get a contact high standing next to you, or you hand me medical marajuana card I will deny the sale.

                              Other than that it's not my job to play detective and figure out if you are going home and smoking a bowl at night. I have enough legal stuff to keep up with.
