Are Federal Special Agents 1 in 30 exempt???

27535. (a) No person shall make an application to purchase more
than one handgun within any 30-day period.
(b) Subdivision (a) shall not apply to any of the following:
(1) Any law enforcement agency.
(2) Any agency duly authorized to perform law enforcement duties.
(3) Any state or local correctional facility.
(4) Any private security company licensed to do business in
California.
(5) Any person who is properly identified as a full-time paid
peace officer, as defined in Chapter 4.5 (commencing with Section
830) of Title 3 of Part 2, and who is authorized to, and does carry a
firearm during the course and scope of employment as a peace
officer.

If their job duties match these requirements.

Right, my thoughts exactly, but then I read a thread here a couple of days ago where a Federal agent said that he was denied his off roster purchase. It wasn't in the FFL section. (Yeah, I sometimes venture outside of my comfort zone to read the rants of others)

I just had a Fed pick up an off roster he DROS'ed, and he had shipped us another pistol, we had it, he asked if he was 1 in 30 exempt, and I said, hummmm, not sure let me check, and he was under time constraints and had just flown back into the States on the red eye and was looking to get home asap. He stopped by us on his way back from the airport and just wanted to get home and go to bed. So he said he had no problem waiting another 2 weeks until his 30 would be up. But, in our never ending quest for understanding I needed to find out for sure.

yes they can buy off roster

Yes they are 1 in 30 exempt (they have to be LE to get off roster)

No they can not buy high cap's

I'm trying to understand this as well based off of statute and anecdotal references. This is how I interpret PC27535:

1 and 2 are describing entities, which the FLEO is not.

3 references PC830 for CA Peace Officers, which the FLEO is not. Note also the "Full-time paid" portion.


In respect to the topic, when does the agency letterhead from the top official come into play?

You can always call the DES Helpdesk and ask if they can get you in touch with a field rep. I did it the other day and I had to scan and email them a picture of the ID and I had an answer within 10 minutes.

This particular agent has purchased from us frequently. It just threw me off a bit when I read that other thread. Just wanted clarification, and it seems that everyone proved what I was 85% sure on.
