    Immigration Status Changes / Citizenship

    Hi Calguns FFL's,

    Thanks again for fighting the good fight in this oppressive state.

    Two quick questions, one for me, one for my buddy.

    I recently became a US Citizen (a month ago) and am going to trade handguns with a buddy. Is there any delay in changing my citizenship status that may cause problems for our DROSes?

    I ask because I had an issue when I transitioned from a work visa to Permanent Residency and my DROS was rejected. I was instructed to wait a certain number of days before I DROS'ed again.

    Is there such a thing when going from Permanent Resident to a Citzen?

    My buddy also transitioned from a work visa to Permanent Residency last week. He wants to buy his first HK and is wondering if there is still any sort of delay involved.

    There's no delay I'm aware of, but since you've experienced an issue you may to contact DOJ to see if they can give you an answer.

    I would suspect if you both are supplying all the correct documentation that they can't reject you.

    The only customer I've had in a similar situation had just got their I94 renewed and they knew they had to wait 90 days (per federal residency rules).

      Sorry for the confusion - my buddy with whom I want to trade guns is a US citizen and has been since birth.

      My buddy who is a new Permanent Resident wants to buy his HK new from a LGS

        There should be no delays. Check your immigration status accordingly on the form and you're good to go.

          Did you go to Social Service office to update your nationality status ? DOJ won't know your current nationality unless you update it

              Nor do they check this so it's irrelevant to the DROS process. I've had customers that had been checking "Yes" to being a US Citizen only to find out later they were a greencard holder. I had to rerun DROS, but they told me that they had purchased numerous guns that way in the past and it never got rejected in the background check. Go figure...

                Did they also falsify the 4473?

                    Years ago I had a customer who the day after he became a citizen came in to buy a gun. We were making a big deal of it because it was his congratulations for sticking with it and becoming a citizen we even threw in some free ammo for him.
                    If I remember correctly the was denied. The reason why was they said he had to be a citizen for I believe it was 60 days before he could buy. This made no sense as he had been buying guns as a green card holder for years.

                    I don't know if this has changed now.
