    Japanese type 89 mortar advice

Its a 1929 Type 89 and it has not been de-milled (demilled: large hole in the side and bar welded on inside of bore).. It is severly rusted, missing parts, I would say its completely inoperable. I am a type 01 FFL in Southern California(for about a year now) and I was beginning to research/list it on gunbroker when I realized it might be considered a Type 3 DD. I did not do an acquisition on it because I believed it to be a WWII relic.
Before I do anything I wanted some consultation from someone a little more experienced. I've been researching online and I see a lot of grey areas. HELP!

Am I at risk of a BATFE violation?
Is there a place I could send it to to be demilled?
Can I sell it online as type 3 parts/accesories?
    Thanks
    -John G.
