Had one sent in today and as far as I am concerned this cannot be DROSed. It is neither a break top nor a bolt action and does not meet new SSE requirements as of January 1st 2015.

Am I correct?

We have a ruling from DOJ in writing that this pistol is not legal for DROS in CA to non LEO.

But is it a "Bolt Action". It does have a rotating breech / Bolt

I don't think the rotary breech lock will pass muster as a bolt.

I get that it 100% should be legal but CA rewrote the law to specifically mention bolt action or break top.

I explained it to buyer and he found a pawn shop that will DROS it because it is Single Shot.

My moral compass says educate the pawn shop as they may not be aware of the specific changes of the SSE that went into law this year. But if I do this a good customer, and Calgunner, is screwed out of a gun.

Yes but you would be saving a fellow FFL from possibly getting in hot water.

I would not set a FFL up to fail any more then I would want an FFL to set me up.

Tell the other shop why you will not do it an let them make a call on if they want to do it or not. Someone could make a case that it is a SSE2. Just won't be me.

The Customer bought a pistol that they can't have here in CA they stepped in it you didn't. Not that I like the rules but they are what they are.

Yikes, I've been in to their shop a couple times. They have always been pretty nice guys when I've talked with them. Maybe, its possible that EV pawn didn't get all the facts from the customer who wants them to fudge the transaction. I would appreciate it if another FFL reached out to me if something questionable was going on. So my $.02 is give them a ring and speak with somebody over there who is a higher up.

Update. Spoke to the pawn shop, they were not aware of any law changes.

Spoke to customer, he was upset with us. He said they will do it, they did one before in February, and that a rotating breech is a bolt action. He says it is just a play on words and that the DOJ has no problem with it.

I informed the FFL and did my part, up to them now.
