    Refuse to Sell section

    Does anyone know where I can find the section of FFL guidelines that specifically addresses a dealers right to refuse to sell? Im looking for general provisions not just CA

    I did find an ATF newsletter stating such but I need the actual code/ statute

    18 USC 922 gives the Federal versions of the crimes of
    - selling a gun to under-18
    - selling a handgun to under-21
    - selling a gun to a 'prohibited person'.
    and others.

    CA Penal Code has comparable state crimes to the Federal crimes.

    There is no reasonable way a buyer should be able to compel a selling dealer to commit a crime.

      I'd like to see the ATF opinion if you have it. I was always under the impression that ATF said that FFL's can refuse a sale if they feel uncomfortable or does not seem right. I'd think that does not mean if someone is a redhead or Black you can refuse the sale if you don't like such people. I do remember that retarded ATF bulletin about how to recognize domestic terrorists buying guns or something. A lot of the things they said to look out for apply to many normal people like buying guns far away from where you live.

      I was once in a gun shop and the owner was about to refuse a sales it seemed very straw. A guy came in with his mom and he wanted her to buy an AR. It seemed very odd and not right I think I'd of refused it. Excuse he used why he was there and he was swearing up and down was gun was not for him was his mom felt uncomfortable being around guys in a gun shop and that they would make passes at her or something.

      Not to be mean but lady was fairly old and not very attractive and even if she was it wasn't like we were going to sexually assault her in the shop or something. You'd have to be there but whole thing did not pass the smell test. In another case I saw a middle aged overweight kind of hood rat type Hispanic woman by herself attempting to buy an AR and not knowing much if anything about them.

      I don't like to stereotype but very likely I'd of refused the sale unless she could convince me in conversation why she wanted it and at least knew a little about them. Once again seeing it in person and her vibe you would understand better. Store seemed to just wanted to make a sale though.

        What the hell does "not being very attractive" have to do with selling or not selling someone a firearm. Does that mean only "attractive" people should be sold guns? Seriously?

          Did you read the whole thing? Do you know the context?

          What I read was that the reason the son was there because the mother thought that the guys in the shop would be hitting on her. That comment related to that.

          Perhaps only people who read the posts should be able to respond :-).

            There is no code/statute. What would have to be there is something to force a FFL to always do the transfer/sale, which does not exist. You need to reverse your question and ask where it is listed that a FFL must always do the transfer, so when you don't find that, the answer is that they don't have to.

            Unless you can prove illegal discrimination, the FFL does not have to do business with the person. Straw purchases are a prime example since you can generally never prove it, so if the FFL has concerns, they can refuse to do the transfer.

                Yes, thank you. I knew someone would not understand. My whole posts needs to be read and to be honest it is hard to explain you had to see it and to have been there. Both situations did not pass the smell test. I doubt if it was my shop I'd of sold the guns especially in the 2nd situation I witnessed.
