    Gun delivered but not picked up

    We had a customer come in to pickup his transferred in firearm after 10 days so we clicked deliver in the DES system. While giving him 4473 and DROS paperwork to sign the customer said he forgot his ID in the car and went to go get it.

    Well he never came back and it has been a week. We have called, texted and PMed on here but no response. So now we have a delivered gun in the DES system but no signed delivery 4473 or DROS form but obviously still have possession of the firearm.

    You could call the DOJ and see if they can do anything on the back end to reinstate the approved/undelivered status, but that's a long shot.

    I'd wait til the 30 day period is up then cancel the DROS if he hasn't come in. If he does come in to pick it up before 30 days, then send in a DROS correction form noting the actual pickup date & time.

      I have a call into compliance but the DES help desk was no help.

      The 30 day window can't close, it's already delivered in the system.

        Even though it's been "Delivered" in error, you should still be able to cancel it in the DROS system. I would wait until the 30 day period of actual time (not DOJ button-pressing time) is past to do that though. If the system won't let you cancel it, there's still the snail-mail paper correction form (which also has a cancel option).

            If you haven't done so, maybe a letter to his address? That is so odd.
            Hopefully he is still alive and well!

              I'd suggest a "registered letter" with signature required.

                Wow, I thought I had seen most of the strange things that could happen at the shop. This one is new on me.

                  Don't mark it as delivered until you have ALL of the required documents, including seeing their ID again.

                  You could call the person since their number should be on the DROS. They might have lost their ID, but they should have come back in and said something.

                    Yes we changed our policy. All docs in hand before pulling paperwork.

                    Live and learn I guess and I hope the guy is ok.

                      I'm pretty sure the cancel button is still available even after clicking delivered. What I don't know is if it reverses the registration and invalidates it.

                        I think it's a federal requirement to see their ID again to ensure it matches the 4473.

                        For the state dros, you are only required to make a copy of their license if your swiper does not work.

                        I could be wrong so hopefully someone else with more experience can chime in.

                          ARTICLE 2. Grounds for Forfeiture of License [26800 - 26915] ( Article 2 added by Stats. 2010, Ch. 711, Sec. 6. )

                          26845.
                          (a) No handgun may be delivered unless the purchaser, transferee, or person being loaned the firearm presents documentation indicating that the person is a California resident.

                          (b) Satisfactory documentation shall include a utility bill from within the last three months, a residential lease, a property deed, or military permanent duty station orders indicating assignment within this state, or other evidence of residency as permitted by the Department of Justice.

                          (c) The firearms dealer shall retain a photocopy of the documentation as proof of compliance with this requirement.

                            That is "Proof of residency", not identification (for the state requirements).

                            From the 4473 instructions (federal):

                            "Question 20a. Identification: List issuing authority (e.g., State, County or
                            Municipality) and type of identification presented (e.g., Virginia driver’s license (VA DL), or other valid government-issued identification).

                            Know Your Customer: Before a licensee may sell or deliver a firearm to a nonlicensee, the licensee must establish the identity, place of residence, and age of the buyer. The buyer must provide a valid government-issued photo identification to the seller that contains the buyer’s name, residence address, and date of birth. The licensee must record the type, identification number, and expiration date (if any) of the identification in question 20.a. A driver’s license or an identification card issued by a State in place of a license is acceptable. Social Security cards are not acceptable because no address, date of birth, or photograph is shown on the cards. A combination of government-issued documents may be provided. For example, if a U.S. citizen has two States of residence and is trying to buy a handgun in State X, he may provide a driver’s license (showing his name, date of birth, and photograph) issued by State Y and another government-issued document (such as a tax document) from State X showing his residence address. If the buyer is a member of the Armed Forces on active duty acquiring a firearm in the State where his or her permanent duty station is located, but he or she has a driver’s license from another State, you should list the buyer’s military identification card and official orders showing where his or her permanent duty station is located in response to question 20.a."

                            It may not be a legal requirement, but I always check ID on pickup.

                              I take it that you have not read the instructions for the 4473.

                              Page 6, Section C.

                              I think that CA also requires it, but it does not matter since the Feds require it. It does not say that you can look at a copy of their ID.
