FFL holding a Firearm because of their mistake

I recently did a ppt as the buyer and the FFl forgot the sellers signiture on a single document. They are claiming the rifle is still in the sellers name. my DROS is clear and I have a pickup date and time so they must be mistaken correct? Is it legal for a ffl to hold a firearm for this reason? What can I do to ensure I get my rifle. Please help thanks

Yes they can hold it if they screwed up. If he can't get the seller's signature in time I would expect him to re-DROS it to you for free. If for whatever reason he is unable to get the seller's signature in time the seller will still be back to pickup the firearm. I would meet him there on that day and re-do the paperwork. I would also get the FFL to do it for free if I were you.

The firearm is not still in the seller's name. The CA DOJ does not know that the seller did not sign the document. It is a good idea for the FFL to not complete the transfer until they get the signature though. Holding the firearm is the only thing that they have to convince people to do what is needed.

I would suggest getting the seller in to sign the document ASAP.

I would expect if he didn't get all the right sigs he would cancel the DROS. That would then trigger the return to the seller and all the hassle involved.

I would think that he would try to get the signature so that it could be completed, but talking to the FFL would get the answer as to what is going on.
