    Roster exemption for peace officers

Does this include retired peace officers or only active?

What about high capacity magazines? Is there a FAQ on do's and don't as a FFL with dealing with law enforcement?

Active only. Off roster and mags. Once retired, other than LEOSA they pretty much have no special privileges when it comes to firearms.

I remember reading somewhere that Federal LEO don't get benefit for hi-cap mags. Someone else might be able to confirm PC or DOJ info around that.

Really? Not trying to sound confrontational but do you have any proof of that? It is contrary to what I have heard.

This is the LEO "Large Capacity" exemption.

32405. Section 32310 does not apply to the sale to, lending to,
transfer to, purchase by, receipt of, or importation into this state
of, a large-capacity magazine by a sworn peace officer, as defined in
Chapter 4.5 (commencing with Section 830)
of Title 3 of Part 2, who
is authorized to carry a firearm in the course and scope of that
              officer's duties..
Here is the excerpt of said Chapter 4.5 regarding Federal LEO's

830.8. (a) Federal criminal investigators and law enforcement
officers are not California peace officers, but may exercise the
powers of arrest of a peace officer in any of the following
              circumstances:

About the only thing they get is they do not need a FSC as they have a CCW so to speak

                Long story short...
Under Lockyear Feds had the same rules for buying as state.
Under Kamala Feds have no rights.
SB-363 amended PC32000 to add Federal to the roster exempt list.

                Summary now is:
                Feds can purchase off roster:
Feds can Purchase Assualt Weapons (With Agency Letter)
                Feds can not buy highcaps.
Feds can not be exempt from the 10 day wait even with letter.
Feds are not 1 in 30 exempt.

                  Some good info.

How about putting together a cheat sheet on what FFL's can do for Federal LE and CA LE?

Retired Cops in California are not exempt from the 10 round limit on purchasing magazines. Retired cops can of course keep, use and repair any and all magazines they personally owned prior to retirement. Retired cops can use high capacity magazines in any and all weapons they own with the exception of California listed AW's, unless they are legally registered with Ca DOJ. Any California FFL that sells, gives or otherwise supplies a high capacity magazine to a retired cop is breaking the law.

And yes as a retired California cop with a 30 years of service it does piss me off.

Can an active LEO confiscate your high capacity magazines as a "nuisance"?

I know of no CA. Penal Code section that says it's against the law to be a "nuisance". However, there may be city or county codes that address that sort of "violation: depending upon where you reside.

32390. Except as provided in Article 2 (commencing with Section
32400) of this chapter and in Chapter 1 (commencing with Section

giving, lending, or possession of, any item that constitutes a
nuisance under any of the following provisions:

                          (20) Section 32390, relating to a large-capacity magazine.
                          (b) These weapons shall be subject to confiscation and summary

So Leo's may only have hi-cap mags if they owned them prior to the law passing?
