Pistol DROS when customer is not present

Any of you guys DROS pistols for customers when their 30 days are up if they have a couple they want to buy?

I'm not sure whether we can do this or not if they aren't present since I thought I read you had to attempt to swipe the drivers license?

This is assuming that they previous pre filled out a 4473.

4473 is to be signed an dated at start and pick up. how are they going to do that if they are not in your shop? back or post date?

Some FFL's have the customer fill out a DROS worksheet and a 4473. Similar way it would be done at an event/show if internet is not available.

We do it this way.

ETA: Also, we've done this method when our internet has been down as well. We're in a shared office space and sometimes the internet goes down (power outage, etc...) When we have customers come in to start DROS we do the "manual" method as well so they don't have to make an additional trip.

Can you provide me a breakdown on the steps including from start to pickup since I am new and want to make sure all steps are covered. My thought process is to do this when a customer picks up their first pistol after 10 days and I have everything ready to start Dros after 30 days.

1) Collect all paperwork as you would normally, including copies of DL/ID, FSC, POR, whatever else you keep
2) Fill out 4473 as normal
3) Fill out DROS worksheet in full, sign, date, thumbprint on back -- this allows them to read and check off the 4 questions you typically ask from the DES page (are you a felon, etc..)
4) When date comes up run run in DES, print pending copy
5) Process pickup as normal
6) Not sure if required, but on pickup I have them also sign and print the pending printout. Not sure if this is required, but don't like to have the blanks on the paperwork even though they already signed/thumbprinted "manual" DROS worksheet

Timing wise I typically do it as you mentioned, when they are picking up they prep paperwork for the next.

I read somewhere that we need to swipe their drivers license on pickup? Do you do this?

Not sure where it would go on pickup. So no, we don't do that. I do swipe it when I prep their next set just so I get that step done. I don't use the data from the swipe though since I'm doing the manual form.

I remember I read this on the CA DOJ FAQ under DROS.


Can I initiate a DROS at a gun show without swiping the purchaser's DMV issued driver's license or identification card if I am unable to use my DOJ-issued or privately owned PC at the show/event?
Yes. You may initiate a DROS at a gun show using a paper DROS worksheet. Upon return to your business location, you may manually input the information into your DOJ-issued or privately owned PC using the keyboard. Please remember, the 10-day waiting period does not begin until you submit the DROS to DOJ using your DOJ-issued or privately owned PC and receive a DROS number. Additionally, prior to the delivery of the firearm, you must swipe the purchaser's DMV issued driver's license/identification card through your DOJ-issued magnetic card swipe reader. Then, print out and attach the information to the copy of the DROS that is retained in your dealership records. Following this process complies with the requirement as long as the information on the purchaser's DMV printout matches the same information recorded on the DROS. Detailed instructions for this process are as follows:

Click on the Windows "Start" menu located in the bottom left-hand corner of the screen. From the "start" menu choose "Programs" then select "Accessories" then select "WordPad". Next, swipe the purchaser's DMV card through the reader and the information will automatically transfer to the WordPad screen on your PC. Finally, to print the information, choose "File" from within the WordPad program application and select "Print" and then click "OK".

How can I comply with the requirement to capture the purchaser's DMV information using a magnetic card swipe reader if the reader malfunctions or the stripe on the back of the card is defective?
If your DOJ-issued magnetic card swipe reader malfunctions or if the purchaser's DMV card's magnetic stripe is defective, you may manually enter the information using your keyboard. Additionally, you must retain a photocopy of the purchaser's DMV card along with the original DROS.

Why do I have to swipe the card prior to delivery of a firearm sold at a gun show instead of making a photocopy of the purchaser's DMV card as discussed in the answer to question number two?
Penal Code section 28180, subdivision (b)(2) specifically authorizes dealer's to obtain a photocopy of the purchaser's DMV card in the event the card cannot be swiped through the reader due to technical limitations. However, there exist no statutory/legal exemption from this requirement for transactions that occur at gun shows.
