Consignment roster exempt?

    Consignment roster exempt?

    A question has come up in a different thread. Are firearms on consignment
    at a FFL exempt from the roster? I thought they were just like PPT.

    If handled as a PPT they can be treated as a PPT.

      I might be confused by this as well. I always thought once the firearm was officially acquired by you it needed to be on the roster. I have seen other shops selling off roster pistol and was never sure the exact way to legally do that. I assumed maybe they took the firearm in via the repair book and when someone wanted to buy it they called the customer to do a PPT. That is great if I can acquire an off roster pistol and sell it as PPT later as long as the buyer and seller are present at the same time? Is that the case?

        A consignment firearm is not actually part of inventory, so it can be done as a PPT. The seller can fill out a DROS worksheet in advance. You do have to be a secondhand dealer and do the FDAS stuff.

          Just to get this all 100% straight since I have not done one of these before. The firearm would need to come into inventory and be process as a normal consignment and processed through the DOJ like normal and be subjected to a 30 day hold. I would also have the seller who is consigning the off roster handgun fill out a DROS worksheet form as a PPT and just leave the purchaser info blank for the time being? Then I assume when a buyer is found and the 30 days is up they complete the DROS worksheet as the purchaser and the DROS is then started electronically as normal. Does the seller need to come back in for any other reason than to collect their money? No other paperwork to sign and they don't have to actually be there the same time as the purchaser?

          Sorry for all the clarifications I just want to make sure I do this right; I have two customers currently interested and they should sell quick.

            The DROS can be submitted before the 30 days is up, but the firearm can not be released until after 30 days. It is a risk to submit the DROS before the 30 days since if there is an issue, you won't get the DROS fee back.

            The purchaser does not need to fill out the DROS worksheet, you just need the seller's signature on it so that when you submit the DROS, you have the required signature.

            Yes, that is the basic process. The money can be sent to the seller, so they don't really need to come back. You do have to submit the require paperwork when you receive the firearm.
