Need the 1975 transfer of a shotgun from mother to a son by gift be done either through an FFL or reported to the DOJ on what I believe it was called something like an OPLAW or Intrafamilial Transfer Report? Both were California residents and everything took place in California.

Sorry for the confusion. Am I correct that this was a legal transfer under the law in effect in 1975? It is a shotgun, not a handgun, all parties were California residents, and nothing took place out of state. Perhaps I should add this was the only time a firearms was sold, gifted, or otherwise transferred between members of that family.
I confused the OPLAW with the requirement of PC 12078 that for the intrafamily exception to apply to an infrequent handgun transfer the transferee must make a report to the DOJ. It doesn't specify a particular form.Last edited by Chewy65; 03-04-2015, 10:56 PM.Comment

It was 1991 that the state decided it wanted paper on most transfers; it was 2014 that it decided long gun intrafamilial transfers should be included.
In 1975, it was 'Hey, dad, can I have your old 870?' - 'Sure, kid, enjoy!' and that was the end of it.

The requirement to document transfers between private parties in California did not start until 1991. If the transfer happened in 1975 then the state probably has no record of it (and that is okay because the transfer was legal).
If you wish to document your ownership of the firearm to the state now you may do so by filing out this form, and sending in a $19 check.

Thanks all. I had looked at the wiki and ever applicable code I thought might even apply and agree that, to paraphrase Librarian, it was take the gun son.
Some may find interesting why this came up after all these years. I called the local sheriff about disposing of of the gun. He was telling me to break it down and bring it in, when told me to talk with range operator since they were familiar with firearms law. I think he was concerned that I might be screwing myself when all I wanted was to do the right thing.
It just goes to show you that not all cops are out to nail everybody.Comment

I turned it in to the sheriff because (a) it wasn't worth a dros fee, (b) it was unsafe to shoot, and (c) it was good for nothing but trouble, if that.
The wrist of the stock was badly cracked, the firing pin was bent and didn't want to retract, bead was broken off. If anyone got it working they most likely would saw the barrel off and turn it into a PGO.
You may be right and the guy was trying to tell me to take it to the range and someone would buy it. When I turned it in, the guys at the front desk even asked whey I didn't sell it.Comment
