When the crap is hitting the fan you can do whatever is Reasonable. You can protect yourself against attack/injury the best that you can. That might mean safely/slowly retreating to a secure/protected position/location; that might mean running away; that might mean bluffing/scaring the dog; that might mean using your empty hands to fight; that might mean arming yourself or deploying and employing a dedicated or improvised tool/weapon; etc. YMMV with all the above, including spray...Comment

Personally, I would do that intentionally BEFORE "talking to the owner". Any talking to owner will ONLY result in him thinking you are now "cool with it". Then it will all about how you "lied". Figure you are training him like he didn't train his dog. He needs to learn what will happen EVER time without fail or negotiation. Does he let strangers use his lawn for long term parking?
1st pickup from pound is $100 and goes up fast from there.
3rd time and they will likely get a court date to talk about their "animal abuse" issues.
This is VERY much where you want to 'work with the system'.
I've been through this 3 times (2 against a dog and 1 against my buddy's dog) and each time Animal Control has been "all business".
PS-I was "just" barking all day in the back yard for my buddy's dog and for that AC was reading us the riot act about talking the dog (and maybe not giving her back
)
Oh, yeah, once a fellow apt renter decided to let his brother 'store' a dog in the common yard with makeshift fence I guess everyone was supposed to figure out how to keep closed for his large aggressive dog. Even though I'm pretty handy I guess I didn't do the fence right and after two pickups by AC they found another place for the dog.
If human LE worked like I've seen AC work there would be no crime.
PS-I'm impressed by how well and fast AC can locate and collar a given dog they get called about. I remember a couple times "the whole neighborhood" was searching then AC shows up and bags the dog within 10mins (just one girl AC officer and she wasn't looking too 'fast on her feet')
But by all means get the Pepper Spray just because its a good legal self defense (under certain size) for warding off human, sub-human and animal attacks. While maybe legal "self defense" I'd advise against it. LOTS of 'fights' start over this issue and if the OP doesn't have the local LEO Union legal team behind him he could easily end up with criminal charges, especially with the neighbor's family/friends backing up his story.
Neighbor's neighbor may be fellow "dog lover" etc and be more that happy to tell LE how you walked up to the nice dog and kicked it. "Animal Cruelty" not just real crime, but you might be on TV/newspapers and not in a good way.
Plus the OWNER is the one who deserves the "boot to the head". Dog thinks he is doing what "the boss" wants.Am I a good shot!?!, YEAH I'M A GOOD SHOT!....i just got bad aimComment

The more I think about it the more I don't want to physically walk up to their house and have them open their door in the event that I am also greeted by their not so friendly four legged friend. Of course people don't seem to face reality when they are told about their pets and the like.
I may just stick to creating that paper trail of incidents and purchase some good pepper spray.Comment

Generally these threads are just younger guys looking for permission to shoot the dog. That is a terrible idea and should be used as an extreme last resort. You have plenty of other options:
-Talk to the owners, let them know that if there is a bite that you will make sure the dog is quarantined and a possible lawsuit may follow. (that shapes a lot of people up.)
- Most dogs acting aggressively, aren't. Aggressive dogs don't usually telegraph before they bite with loud barking and posturing. They're a lot more focused and quiet than loud and obnoxious.
- A lot of times you can just walk away from the dog and they'll sit there and bark but won't do anything about it.
- If the dog is getting too close for comfort. Put something in between you and dog. If you have a backpack or something, feel free to use it as a barrier and take a few swings towards the dog.
- If you don't have something to use, a good swift kick from an adult will usually change the mind of the dog about if he wants to stick around.
- Pepper spray can also be an effective deterrent.
- My personal favorite: bend over like you're picking up something (imagine a rock) and then wind up like you're going to throw it. I don't know if it's a fetch instinct or preservation instinct, but dogs generally don't stick around if you act like you're gonna throw something at them. I've never had this fail, as stupid as it sounds.
You must be a dog lover, I like dogs too...
Doesn't this sound similar to using a rape whistle or throwing coins at an attacker... Reminds me of a news story that played recently

Remember the legal limit is 2.5OZ in CA.. Probably 10% concentration. It's really easy to get the larger size I guess but remember we are in California so you don't get that freedom

AC will most likely give them the "We are concerned your dog could get hit by a car if allowed out off leash" speech to deflect any neighbor VS neighbor probs. Quite true. A buddy just had his fairly exp, generally well trained outdoorsy dog get killed after the dog flew off across the street after another dog or cat or something. My experience
Back in 1991 I was walking down our street collecting signatures for a petition when a dog came off a property and actually bite me in my right elbow thru my jacket and my skin did break.
Since I had clipboards in my hand, my hands were occupied, I wasn't expecting the dog to come of the property and actually bite me. If the clipboards were more solid, I would have bashed the crap out of that dog.
I walked back to my house, I was pissed and actually considered taking my 45 and putting a few rounds in that dog. Of course being in Los Gatos California at the time meant that probably would be frowned on by local police, so instead I called animal control.
Animal control arrived at my house, I showed them my wound and pointed them at the house where the dog was at.
I never confronted the owner, should have sued, but never bothered. Figured they probably sweated getting sued for about 2 years. My arm recovered.
What I do know is I never saw that dog again.Comment
