I understand a LEO can purcahse off roster handguns in CA. I also understand that a private party can transfer off roster handguns. My question is, could a LEO transfer a non-roster handgun to a non-LEO privately??

LEO off roster question....

IF he/she does it for the purpose of transferring it to someone else, that is an illegal straw purchase. They will lose their job and face fines and possibly jail time. Don't do it.
But police officers sell guns all the time. So it is legal for them to sell off-roster guns to private parties, it is not legal for them to buy off-roster guns expressly to sell to non-LEO's.
Weird gray area, intent is hard to prove, but it is never worth it to risk a career or more for a toy for a buddy.Last edited by hunterb; 01-22-2015, 3:13 PM.Originally posted by johnthomas...The hardest part getting rid of crap is getting started.Comment

My buddy is LEO and already has a non-roster handgun he wants to sell. I would never risk his career for an off roster handgun. I have plenty or relatives in other states if I wanted to get around the law. Just wanted to make sure it would be legal for him to transfer one he already had to me.
Thanks
