    BART Police

    My family just got a letter from their insurance agency.
    Last December my mom was hit by a BART police officer, and it sent her car rolling down the freeway. The officer was going over 100mph, and hit her as she tried to get out of the way.
    CHP deemed the fault of the accident to be 100% the BART police officers fault.

    Now BART is refusing to pay for the damages to the car(totaled obviously), or for any of my mother or her sister's medical expenses. Now it's going to take months or years in court.

    Is this standard operating procedure for a police department?
    I'm disappointed by the BART police department on this one.

    What really grinds my gears is that the officer was responding to a fair evasion. I'm not sure that warrants going 110-120mph down the freeway. That was reckless, I almost lost my mother and aunt due to a bad decision.

      Refusing claims filed against a City, County or District has nothing to do with the agencies police department, In this case it would be BART's legal department that would be denying the claim. The PD would have nothing to do with it.

        Yes, it's the legal department causing issues. I would be curious to see their reasoning for not paying anything... or if it is simply a case of an offer they put on the table being refused on your insurance's end. Who knows, but again, this really doesn't seem to have much to do with BART PD at this point..

        As a side note, I thought all LEO's covered for each other..??!? How is it possible that CHP could have written a TC report in which another officer was found totally at fault??

          What you are experiencing is normal/typical Government in Action. Please understand that I do not mean that as a negative, that’s just the way it is. While I do hope you have engaged a good attorney, it sounds as if you may not have done so. The first thing you need to do is get a good personal injury attorney, and follow his advise. As noted above, the normal response from a government agency is to deny the claim.

          Please believe me, under no circumstances should you or any member of your family try to settle this issue without legal representation. You will lose.

            You better have complied with all applicable governmental claims requirements and, like all have said, have an attorney.
