Off duty vehicle stops?????

    We have a guy who does it occasionally. But his stops usually result in arrests so I guess the end justify the means.

      My wife had an 86 GMC years back that I had built a semi-aggressive. 350 for. It was 4x4 with a th350 trans and 35" tires. It also had 1 3/4" long tube headers, glass packs, and baloney tubes kicked out in front of the rear tires. She likes trucks and guns.

      Anyway me and a buddy were tearing around in it one day and I got on it hard(it would destroy those 35s) on a city street. About three blocks later there was a state police car behind me with the lights on. It was an off duty ISP trooper in a pair of shorts and no shirt.

      He told me "I know you are having fun, but don't do it in front of a troopers house when he is outside talking to his neighbor!"

      Then he asked me to pop the hood so he could check it out. I have him a business card and my shop built and installed the blown big block in his 70 split bumper Camaro a year later.

            In the spirit of education...

            Officers in plain clothes/unmarked cars often conduct traffic stops associated with something else. Detectives, investigators, gang, narc, task force, impact/direct enforcement teams, etc. are often on-duty in plain clothes and unmarked cars. They will conduct stops associated with their investigations. Time of day and location are poor indications of if the unit is on-duty as operations are conducted at any time and anywhere.

            If you are truly referencing an off-duty stop, though you likely would have no way of knowing what the officer's status is, it depends on the circumstances. If in examination of the totality of the circumstances the officer, determines there is a significant safety issue a stop may get initiated prior to a marked unit arriving. Such examples may include suspected DUI, wrong-way driver, significant reckless driving, just about hitting a kid in a crosswalk, commission of a crime, vehicle matching a suspect description, etc. Do off-duty officers typically conduct stops for minor violations: no.

              Friend had a K9 marked unit he took home. He'd make a stop just before he got home and first thing when he left for work. These put him on the clock so he could collect overtime.

                  Please, correct me if I'm wrong. But, I was always under the impression that for traffic stops that the officer had to be in a marked patrol car.

                      In order to work traffic the car must be marked as per CA Vehicle Code. A LEO in an unmarked car may not be assigned to traffic but may act if he sees a violation. If you get a ticket from and unmarked car and he didn't radio for a traffic car to come loan him a ticket book you might be able to argue that he was working traffic in an unmarked car and get the ticket dismissed.

                        Please do not come into the leo forum and give advice about getting tickets dismissed. That is not what this forum is for. Save that for the OT forum.

                              Haha, great advice. Tell the judge/commissioner that he did not radio in to get a loaned ticket book and you win!

                                Completely incorrect.

                                Not to be offensive but this reminds me of when I worked the jails and the "Pro-Pers" were giving out "legal advice" to their cellies. It was quite comical at best.
