I'm almost positive at this point that what the officer did was un-justified. For the same reason a windshield sun-shade can be applied while parked and not while driving.

edit: and AHA, even you posted it yourself that division 12 (where cvc 26708) applies "when upon the highways" !!! not parked off a dirt patch off of a mountain road!!!

edit2: i might have not made that clear, i wasn't on the side of a highway, i was on a big dirt patch off the side of a 1-lane per direction mountain road.. sorry :X
FYI, the "highway" extends beyond the paved portion in most places.

Also, in 32+ years of LE, I never wrote a parked vehicle an equipment violation except for registration or license plate violations. About the only parking cite I wrote with consistency was handicapped violations. I went out of my way to write those, and cut no slack.

        tint color chart

I drive allot I own a newer Ford F-150 crew cab 4x4. I have been stopped for speeding, and one for not coming to a complete stop. My windows never came up as a issue. I was let go on the other two also. I have 30s in the front and 15s the back and rear windows.
Which one do you have in the front?

I have a ceramic blue 80% on my front doors. It blocks heat, and is virtually transparent.

Thank you to the retired LASD and others with actual anecdotes contributing to this thread, I hope the thread doesn't get too shat on before I have the update from the county.

            Cheers
Yes, but the question is, is your vehicle legal to operate on a public roadway with the tinting that you have applied? As I said, you are more concerned with the circumstances under which the ticket was issued than accepting the fact that your vehicle is not legal to operate on a public roadway with the tint. You created the situation by applying the tint. The ticket in this case may not be legit the way it was written, but that still doesn't change the fact that your vehicle is not street legal due to your own actions.
So let me ask you, have you removed the tint?

If I drive my car on a public road, the front windows are always rolled down so that my view is not obstructed.

even when it is raining? even when it is 100*+, you never roll up your windows and use the A/C?

Do you want an AOW or C&R SBS/SBR in CA?

A lot of psuedo experts here, shocked that there isn't stricter training on LEOs
Look, it's plain and simple, I know you're not a judge or lawyer, but try to use your 8th grade reading skills:
You won't be returning to this thread or forum to post your results. This is the leo forum and posting insulting comments like your first one is not acceptable.

Furthermore, personal attacks are not permitted either and that is what you did in your second post.

Continue either one of these in any forum on this site and you may be banned.

Also, by the way, it does not make one iota of difference whether you have your tinted windows rolled down or not. If they are tinted and in violation of the vehicle code, you have committed the violation. Since, by your own admission, your windows are tinted, you are in violation.
