    I have a question....

Let's say someone travels with their guns (locked in a hard case and empty chambered...ect...) on a long trip vacation. Unfortunately, the car breaks down in the middle of nowhere, in the middle of the night. So he decides to load his weapon as a precaution with the intention that once help arrives, he would unload and lock it back in the case. Help arrives in form of an officer, who happens to see the loaded weapon.

How would you, as a LEO, react to this situation? Do you haul the guy back to the station or do you share his concern for the safety of him and his family?

I ask this question because we're about to take a long trip vacation once the kids are out of school in a couple weeks. This would also be the first time I travel with a gun. My thinking is if you're allowed to travel with a gun, what good does it do when it must ALWAYS be locked in a case even during an emergency? The bad guy isn't gonna give you time to get ready. So during the time that you're waiting for help to arrive, can you just arm yourself momentarily?

    Thanks

Each state has different laws. Some states say this is ok, others like california say this is illegal. It all depends where your car breaks down.

Every situation is different, one of the reasons cops use discretion in their daily encounters. Just like so many other things in life there is no one size fits all solution. The law is not always black and white, most of us know that.

If I come upon you holding a gun by a broken down veh on the side of the road, you'll likely have some steel pointed at you and get cuffed till I figure out wtf is going on and determine you didn't kidnap/murder/eat the poor family in the broken down car (dude that sounds like a horror film opening scene). After that, seems like you holding iron is a reasonable act to me if you felt unsafe. But that's just me.

Seems like OP wants to be told that any cop who encounters him in a similar situation would be cool with that. And I won't promise anything. My opinion and actions are just that: my own.

            Three rules apply.
            1. Do whatever it take to protect yourself and your family.
            2. Never trust the police to understand your situation.
            3. Never volunteer any information.

              This.

After I made sure that you weren't a paroled axe murderer from Nebraska and your situation is exactly what you said it was then you and your family would be on your way.

However, there are guys at my work that would take you for whatever they could and shame on you for breakin the law. "Stats a stat."

In the scenario you described, I wouldn't be bothered by it. In fact, unless you were physically on the roadway you may in fact be in an area in which you could have a loaded firearm.

Hopefully you won't have to find out on your trip. Have fun!

Personally, like others said, I would make sure you're okay, not wanted, then send you on your way while you wait for the tow truck. "Spirit of the law" is everything to many many cops.

Hm...that's very interesting. I never know there are so much rules & regulations governing our roads. Is there a way to find out more about this.

Hopefully you won't have to find out on your trip. Have fun!
