    LEO and Hi-Cap Mags

    Happy New Year, folks!

    Met this Air Marshal at a party last night and the conversation converged into firearms. He claimed that he is still allowed to purchase 30-rd AR mags after 12/31, because he is an LEO. I thought AR and hi-cap mags would need to be either department issued or purchased with a department letterhead, otherwise he is stuck with the 10-rd mags just like the rest of us CA civilians. He is also a CA resident, btw.

    No big deal, just curious why an Air Marshal would need an AR with hi-cap mags.... What say you?

    His problem will be that I believe Kamala and her crew have issued an opinion that federal LE are not able to purchase greater than 10 rounders in Ca.

      They don't carry rifles for their job anyway. Sig .357 is what they carry last I heard. It's gonna be funny if some LEOs start getting popped because they don't know the laws themselves. There was just another thread about this same type of thing yesterday I think.

          The Air Marshal is correct. Starting Jan 1, 2014 Federal LEO's can purchase high cap magazines from any authorized FFL dealer in California per DOJ. Last year 2013 Federal LEO's weren't recognized as California Peace Officers and could not purchase any high cap mags and their agency had to supply the high cap mags (semantics). FAMS Federal Air Marshals do carry rifles depending on their details. Happy New Years!

            Great; I can now buy Glock 17 magazines for my actual duty gun. BTW: just like every Calguns members on this board, I do believe that magazine restrictions for every law abiding person is pretty retarded!

              Magazine purchases have not required department letterhead for a long time. Duty use is also not a requirement.

                Does anyone have a link stating that FLEO's are able purchase hi-cap mags after 1/1/14? I've searched and have not been able to locate it.

                    32405 PC-
                    "Section 32310 does not apply to the sale to, lending to, transfer to, purchase by, receipt of, or importation into this state of, a large-capacity magazine by a sworn peace officer, as defined in Chapter 4.5 (commencing with Section 830) of Title 3 of Part 2, who is authorized to carry a firearm in the course and scope of that officer’s duties."
                    LEOs are exempt from the high capacity magazine ban regardless if magazine is for "on duty" use or for a weapon used on duty. They are able to buy 11+ mags for any gun...
                    Many think otherwise due to the language in the manufacturing exemption;
                    23440 PC
                    "(a)The manufacture of a large-capacity magazine for any federal, state, county, city and county, or city agency that is charged with the enforcement of any law, for use by agency employees in the discharge of their official duties, whether on or off duty, and where the use is authorized by the agency and is within the course and scope of their duties."

                        I bought two Glock 17 magazines from Riflegear this afternoon; total PITA for LEO's and law abiding citizens alike.
