        Our department worked the same way. If someone is DUI, they're going to get booked. We never released DUI's in the field that I remember, to me that's bad policy and a huge liability.

          at your dui hearing, you will need to ask for the rifle and gear back. be sure you ask for everything that was taken. after the order is issued from the judge, you send it to the state and await your golden ticket, to go to the PD and pick up your firearm..

          hope that helps.. that was my experience.
