newbie questions: carrying unloaded and locked.

    newbie questions: carrying unloaded and locked.

    hi. I'm new to the group and I am trying to read all these threads about carrying an unloaded and locked in case gun (with ammo in the the box, soft pouch, etc.)


    could an LEO answer my questions (I live in monterey county in salinas).

    1.) can i leave my handgun in my car (unloaded and locked in a case) while parked in a school zone but not parked on school property? (out of plain sight)

    2.) can i walk around with my handgun (unloaded and locked in a case) while i go for a walk? (can it be in a backpack?) can it be in my pocket with a small case that is locked?

    this would be for self-defense and personal protection.

    the threads i read say it is legal and i just want to be sure. i know a ccw would be the best bet but i'm not sure my county would give me one.

    1) Yes. Unloaded in a locked case is the legal way to transport a handgun generally, and also specifically listed in both the CA and Federal 'Gun Free School Zone' laws. There is no set of 'destination restrictions' for transport or leaving in your car.

    2) Less clear, but I suggest No is the answer, due to 'destination requirements' for outside a vehicle.

      Personal prospective I don't think it makes any sense for you to carry a gun in a backpack unloaded and locked in a case in a backpack or locked and in a small case in your pocket.

      You know how long that is going to take to get a back page opened and a a magazine into a gun? Or the case out of your pants unlocked and a magazine into the gun. I just think you are taking chances with this and not thinking this fully though.

      If you have enough time to do all this you should have enough time to run. Things happen quick and you really think if you being robbed that the robber is going let you dig into your pocket or a backpack? or that your not going to be so nervous with all the adrelin going that you can't get it open and loaded.

      Your better off in my opinion carrying either pepper spray or a taser and walking witha dog.

      The way most people get in trouble with guns in my experience on the street is that they do something stupid with them or in general that causes them to get in trouble.

      In general with a locked backpack and or a locked case in a pocket, etc the police officers are either going to need

      01. Your consent
      02. PC to get into the bag.

        Librarian: I have not heard this previously. "There is no set of 'destination restrictions' for transport or leaving in your car.". I was under the impression that in Ca you must be transporting to and from particular destination. Basically not permitting transport for personal protection.

            I'll add some small clarification to Librarian's post.

            1) This is exemption is for to/from/within a motor vehicle - the letter of the law is also that its for "citizens"

            2) If you are not going directly to/from a motor vehicle (or not a citizen) there are 'destination requirements' with only incidental deviations allowed.

            So, from you motor vehicle into your office. Office back to vehicle. Perfectly fine. But, from motor vehicle to the mall and walk around; not legal.
