Off Roster Purchase for Fed Agents

Can someone please post a cite of the CADOJ Regulations that would prohibit an active Federal Law Enforcement Officer from purchasing an Off-Roster handgun.

This purchase would be for personal use/protection pursuant to LEOSA(HR218) and not prohibited under any Agency internal policy.

    Thanking you in advance.

here is the PC that prohibts the sale of an unsafe handgun.
32000. (a) Commencing January 1, 2001, any person in this state who
manufactures or causes to be manufactured, imports into the state
for sale, keeps for sale, offers or exposes for sale, gives, or lends
any unsafe handgun shall be punished by imprisonment in a county
    jail not exceeding one year.

you then need to see if you can find an exemption for federal LEOs in this section.
    (b) This section shall not apply to any of the following:

    (4) The sale or purchase of any pistol, revolver, or other firearm
capable of being concealed upon the person, if the pistol, revolver,
or other firearm is sold to, or purchased by, the Department of
Justice, any police department, any sheriff's official, any marshal's
office, the Youth and Adult Correctional Agency, the California
Highway Patrol, any district attorney's office, or the military or
naval forces of this state or of the United States for use in the
discharge of their official duties. Nor shall anything in this
section prohibit the sale to, or purchase by, sworn members of these
agencies of any pistol, revolver, or other firearm capable of being
    concealed upon the person.

if the LEO doesn't fall under any of those listed catagories, I don't see him as being roster exempt.
    Jack

Do you want an AOW or C&R SBS/SBR in CA?

      Thanks Jack,

I think it's asinine that Fed LEOs are not exempt Off Roster Firearms purchase, but when major mutual aid situations occurs, CADOJ doesn't have a problem with the Feds lending a helping hand....(1992 Riots and recently Big Bear).

I've assisted many a single Officer Unit, who was on a late night stop/arrest, (and Vise Versa).

          Unit 74-
Not to be argumentative, but given the PC 32000 quote above, where is the Fed LEO exception?

Many of us law-abiding citizens feel the entire concept of the roster is asinine and unconstitutional in the first place.

Yes, Federal LEO should be able to purchase off-roster handguns. And so should anyone else, provided they are not otherwise prohibited.

I just bumped that thread because my input seemed more relevant there.

Given that is would be CA FFLs who must apply any restrictions, the topic seems better in the FFL forum.
