      Since the OP is directing his question to leos and you obviously are not one, please do not come into the leo forum and advise someone how to fight a ticket. That belongs in the OT forum. Thanks.

          Go to court plead guilty and explain the circumstances. Ask for your driving record to be considered (assuming it is good). I have done this a number of times and never paid anything close to bail price. One time I got a "no judgment". Of course being able to take traffic school is at risk.

            +1 for paying fine and traffic school.

            How is it that you didn't see the sign until it was too late? Maybe next time, you will be more vigilant. And pay attention to driving. Not trying to be a jerk or anything. People just seem to have this habit of doing things other than driving while driving.

            Recently saw some guy that had his phone up to his ear in one hand, and a burger in the other. At the stoplight, I commented through the open window, "wow, gives new meaning to the term hands free." I think I startled him, he dropped his burger. Hahaha!

              1- It doesnt hurt to see the judge. Dress well
              2- Plead Guilty
              3- Request a fine reduction and traffic school.

              You'll be spending a few hours in court most likely. Dont be a jerk and play on your phone or fall asleep, show respect.

                Actually, 22350 cvc is "speeding". 22450(a) cvc is fail to obey stop sign.

                To answer the OP's question, judges pretty much go by letter of the law. If he feels the officer is more credible than you in a traffic trial, then he will side with the officer. Many judges will not allow traffic school if you contest the ticket and lose. Judges will often offer traffic school if you are willing to plead guilty at the time of your traffic arraignment. That all said, the judge has the ability to grant you traffic school no matter what. Traffic school does not give you immunity to paying a fien, but it will prevent the violation from showing on your driving record.

                  FYI, 21461(a) is applicable to "sign or signal", it can be used for any traffic control.... Easier sell to the driver if they deserve a break. The fine is less than any 21453 section (red light, arrow, etc)

                  Around $250 instead of $380...

                  At least in San Diego County....

                      If you have the day off, go to court and roll the dice on whether the officer shows up. If he/she does, request traffic school and pay the fine. If he/she doesn't, make sure you stop at all the stop signs and count yourself lucky.
