Retired Out of State LEO question?

I know that there are different opinions on whether LEOSA covers magazines. My question is if I'm visiting my daughter in Cali and my magazine holds 12 rounds am I going to get hassled by local LEO? I'm a retired Deputy Sheriff from Ohio.

I'm just asking for personal opinions, I understand it would most likely be a court case.

Let's say I'm stopped on a traffic stop and I notify them I'm a retired LEO and I'm armed. They for what ever reason find that my magazine carries 12 rounds.

Still doubtful. Unless you were doing something stupid, more than likely it's going to be " have a nice day" and you're on your way.

Frankly, if you told me you manufactured a high capacity magazine yourself I wouldn't care.

Thanks guys, that's what I thought but wanted opinions, realize that at anytime you could get hemmed up by a over zealous officer. I would have said have a nice day when I was working! Hell, in the old days we used to park their car and drive them home for certain offenses, however you can't get away with that today in most cases.

I come out 2-3 times a year to Huntington Beach to visit, will be moving out their within next year.

How is Orange County Sheriff's Office on qualifing out of state for LEOSA?

Don't know about Orange County, but LA County only does quals for its retirees.

In Ventura County, we have the annual retirees BBQ in September. The morning of the festivities, the Dept. opens up the range and qualifies all who want to requal their LEOSA. Works out really well for those who live out of state and come back to see old friends.

Yeah, but they don't issue a LEOSA qualification card for that. Otherwise I wouldn't have to drive to East LA once a year to qual. They only do it on Thursday's at 11:00 am and space is limited.

leo's take care of their own. I have personally ran into retired carrying concealed and it is not a big deal. As long as you notify the deputy/officer upon the stop. I have not heard of anyone doing mag counts.

I poised the same question to the LDF Attorney and here's a synopsis of his response and legal analysis.

If you are in full compliance with LEOSA, (qualed, not drinking etc) you are deriving your conceal carry authority under FEDERAL Law and the Federal Supremacy Doctrine trumps State Law.

If by chance, a State/Local Officer PC arrests you for a LEOSA related CCW violation, invoke and contact the LDF Attorney. He would then seek quashing the State case and file a Writ to transfer the case to the jurisdiction of the nearest Federal Magistrate and have the State case dismissed.

He also stated that he would vigorously pursue a claim of Federal Civil Rights violation(s) for the illegal State arrest as the LEOSA carry authority is a federally derived right. He stated that there are a few cases already adjudicated in favor of the Officer(s).

Btw; The way CALDOJ is running amok nothing will surprise me.
