    Traffic laws question

    I was wondering about a few things with trafic laws.

    1. Do I have to stop at a stop sign on private property. I.E. wal-mart parking lot.
    2. What if its my own property?
    3. What if I am the security for that property? Can I get a ticket for it?
    4. What if the property is privatly owned gated community but the community private street?
    5. Being the security guard for a property does that make me exempt?

    Been curiouse for a while thought I might ask.Thanks yall.

    Is CVC enforced in said parking lot? Are signs posted? Even if CVC is not enforced are you driving wrecklessly to,from,in,about, or near an off street parking facility?

      Lots of variables as some "private lots" have agreements for public enforcement. Best thing to do is stop for the stop sign, even if it isn't enforcible by a PD, there is always the civil liability if you get in an accident.

          There are provisions in the Vehicle Code that allow traffic enforcement on private property. Please check out section 21107.8. It requires a resolution by the governing authority and the placement of appropriate signage.

          Once those measures are taken, specified parts of the Vehicle Code can be enforced on the private property.

          The property owner, and security personnel hired by the property owner, get no special treatment.

            what I don't understand is how are VC enforceable on private property when most (actually all if I'm not mistaken) of my local LE agencies won't take a collision report on private property. that's like in CAs 23123 (cell phone violation) specifically states in the vehicle code that cell phone use in private property including parking lot wouldn't warrant a ticket.

                      Geez...forget traffic laws. With all due respect, think about why you're thinking about the stuff you're thinking about.
                      1. Do I have to stop at a stop sign on private property. I.E. wal-mart parking lot.
                      Do you want to be broadsided by a car coming from the other direction? Do you want to broadside them? Signs are meant to communicate conditions to drivers. Ignore them and the conditions will explain the importance of the sign for you.
                      2. What if its my own property?
                      Take down your sign. Since you've put it up, there is an expectation that all will comply (including you). If you blow a stop sign on your property and injure someone, you will be sued.
                      3. What if I am the security for that property?
                      You can still be broadsided. As "security" if you are negligent (failure to yield/stop) you and your employer will be sued.
                      Can I get a ticket for it?
                      Sure. Write yourself up.....YOU'RE security!
                      4. What if the property is privately owned gated community but the community private street?
                      Usually, gated communities' streets are under local vehicle code (speed, stop signs, etc.)

                      No. You're there for security. Dangerous, reckless conduct does not create security.

                          Keep that in mind. Most parking lot signage does not conform to FHWA standards

                            very serious. so brought it up with an officer at work. he works for CHP ID 171xx and he said he couldn't cite someone on private property for running a stop sign. said all he would be able to do is give the guy some dirty looks. :shrugs:
                            doesn't mean I wouldn't stop but at least I know I wouldn't get a ticket.

                            well just checked with another officer that has a lower ID 121xx he states stop sign would be the only citable sign on private property.

                              RickD427 provided the actual Vehicle Code section that covers this. You can read the actual law and see what it says for yourself. Instead you ask the opinion of various officers who may or may not know the right answer.
