    Retired LEO Question

    I am a retired Deputy Sheriff with CALPERS retirement. I am so sick of CA politics I am thinking about moving to a free state. My question is will my CALPERS retirement be taxed by CA if I'm living in another state? Thanks guys.

    No. No state can tax a pension if you lo longer reside there. Whatever state you move to will tax it if their laws allow for it.

    I know that Hawaii doesn't tax government pensions.

      Interesting, I would have thought the reverse.

      I thought it was the state were the money was earned that taxed it...not the state were you received it. They'll get their cut when you spend it.

        As stated above, if you move out of California, your PERS retirement cannot be taxed by California. This issue went all the way to the Supreme Court a few years back, and is now settled law. At one time California did tax retirees that moved out of California. If you do decide to move out of state, be sure to research what States do not have a State income tax. As an example, if you move to Nevada which does not have a state income tax, you will get an automatic 9% pay raise. Assuming you are in the California 9% tax rate, which most of us are.


        I do know one of our retirees recently moved to southern Washington State. He does most of his shopping in Oregon and lives in Washington. Oregon has no state sales tax, and Washington has no state income tax. The best of both worlds.

            The problem with moving to WA is that they are not a Class 3 State, where as, Oregon in class 3.

            If you want to stay out west, consider Wyoming (no income tax), same for Nevada, and Utah is a nice place to be as well, with much lower taxes.

                  It's not just the income taxes. The folks I know who have moved out of state noted car insurance rates, sales tax, gasoline tax, cost of housing and a host of other things being cheaper. It all adds up to a healthy savings!

                  I don't know how old you are, but check into health care for older people in the area your looking. That will be huge for folks like us! I'm retired too.

                    Thanks guys. Good info here. I'm 62, born and raised in CA, but have reached my limit of BS. Just got done with a AR build and when I installed the Bullet Button and reduced mags to 10 round limit I felt worse than when I had my dog neutered. I think Calif will now try to out do NY with gun control issues, and provide even more entitlement programs to show how "progressive" we are. (Rant over)

                      If I recall correctly, one of the things our wonderful Govenor and State Assembly is trying to do is change that so they can tax a California pension at the CA rate...

                        That would be interesting, since, as 003 said earlier, it has has already been decided by the Supreme that Ca. cannot do that.
