    Question RE: 20mm ammuntion

    Last night one of my partners arrested a guy with a "live" 20mm bullet in his possession. (It should be noted he was not arrested because of the ammo, was found incident to arrest) As i understand it, these rounds are typically electronically primed and military in origin.

    The person is not a felon, nor any other type of prohibited person - is simple possession of a canon round illegal?

    I didnt think it was but this is the debate we got into last night.

    18735. (a) Except as provided by this chapter, any person, firm, or
    corporation who, within this state, sells, offers for sale,
    possesses or knowingly transports any fixed ammunition of a caliber
    greater than .60 caliber is guilty of a public offense.
    (b) Upon conviction of an offense under subdivision (a), a person,
    firm, or corporation shall be punished by imprisonment in the county
    jail for a term not to exceed six months or by a fine not to exceed
    one thousand dollars ($1,000), or by both this fine and imprisonment.
    (c) A second or subsequent conviction shall be punished by
    imprisonment in the county jail for a term not to exceed one year, or
    by imprisonment pursuant to subdivision (h) of Section 1170, or by a
    fine not to exceed three thousand dollars ($3,000), or by both this
    fine and imprisonment.

        Any size non fixed cannon rounds are fine.

        Only FIXED shells over .60 are illegal. I am not 100% positive if they can be legally possessed with a CA, Destructive Device Collector's Permit or not. I would think the permit would allow for possession of ammo but, I haven't looked into getting one yet.

          What is meant by "Fixed" ammunition?

            Projectile, powder and primer all contained in the same shell. Or something like that. Now you've got me wondering if a Maynard round (with just a flash hole but no primer) would be considered "fixed" or not.

            A muzzleloader or breachloader that uses separate powder charges and projectiles does not used fixed ammo. A cap and ball revolver does not used fixed ammo.

              if that is a live round, id call bomb squad or throw it in the sea. If electronically fired munitions are loaded into a gun and not fired they're dumped overboard. static electricity= possible boom
