Good chance that he is prohibited. He needs to submit this form o DOJ for official answers.

so, its just one of those things that if they had a previous history and its deemed sealed it still counts as them not being able to purchase a firearm.... i guess thats the way it is. thank you very much explorerdude. i kinda have been reading the same thing.Right action is better than knowledge; but in order to do what is right, we must know what is right.

If he doesn't mind paying I think $19 at any gunshop, they can do a doj check to see if he's eligible. My brother went this route to see if his indiscretions as a minor would haunt him as an adult. Needless to say, he now has an Arsenal to outfit a small army. I think he got his eligibility checked out at Turners.Originally posted by Colonel David Crockett"Ya'll can go to hell, I'm goin' to Texas!"

I didnt know dealers did checks unless they run a DROS. I think Troysland is talking about a form found on the DOJ website.Comment

nice..... so its just one of those things i guess that depends on the crime and circumstances probably. only reason i'm bringing it up is i at least have the resources (the fine members of calguns) to steer him in the right direction. i wouldn't want him to get anything illegal or have to lie on a DROS. i'd rather use the advice you guys give to have at least a proper way to deal with the situation. thanks again guys. i appreciate it.Right action is better than knowledge; but in order to do what is right, we must know what is right.

Sealed doesn't mean anything other than preventing certain parties from discovering it. It has nothing to do with wiping away the factual existence of what happened.
It's like having a confidential marriage license. Just because others can't look up your marriage license doesn't mean you aren't married.I like guns

A juvenile felony will not apply . He could have got it sealed . From what i could remember there was a time limit to do so. He can also have got it expunged it would have been removed from the state system but not federal . The juvenile are only held so long. If he is some way prohibited it would be smart for hem to go to court request to get the felony dropped to a misdemeanor then expunge it. If your buddy is in the orange county area . I have a lawyer that can get it done depending on how man convictions he had. A lawyer charges from 500-600 to expunged it. You can try to do it your self for 200-300.Last edited by WTSGDYBBR; 04-30-2012, 1:55 AM.sigpicComment

Some misdemeanors still carry a 10 year prohibition against firearm possession so even if you get it reduced per PC17(b) and then expunged it with a PC1203.4 motion, you would still not be able to possess firearms until that time is up.
From what I recall, it has to be a crime of violence like battery or misdemeanor manslaughter or something like that for the 10 year prohibition to kick in. Without knowing what your friend has on his record, I suggest he call an attorney to make sure.I like guns
