    TSA let you off the hook, what about the agency/county that cited you?

      I have a court date.I have aquired an attorney and hopefully wont have to appear and can get it dismissed. It was just a dumb oversight on my part, forgetting the empty magazine was there. I was cited by OC Sheriff.

        It's called "discretion". Use it.

          Yep, I even was allowed by the Sheriff and TSA to continue on my journey and fly back home. Also the investigator at TSA, when I talked to him on the phone yesterday, told me TSA WOULD NOT contact my employer about the incident.

            I forgot to say that I AM NOT going to be on the TSA's No Fly list. I will be in their database incase an incident happens again. So I can still fly. Also I will definately be careful and make sure it wont happen a second time.

                I think (hope) this will go away soon.

                I've heard of people forgetting entire handguns getting a warning letter only.

                      Sounds like the deputy did use his discretion by citing him out on the misdemeanor instead of taking him into custody. He could have done the latter just as easily.

                        You have a court date based on the citation, but the DA still has discretion on whether to file charges and what charges to file. Sometimes there can be a benefit from your lawyer talking to the DA and making sure they have whatever mitigating information you can offer. The DA's job is to see that justice is done and the majority of them believe this. It is possible they will decide not to file charges at all. The DA files the charge not the sheriff. It is harder to get a charge dismissed than to keep it from being filed by persuading the DA that the interest of justice is served by not filing. A lot depends on how well your lawyer can deal with the DA and this is more likely to work in a smaller jurisdiction where both sides know each other. It will help if your lawyer has credibility with the DA. Good luck.
