Moving your car after a minor T/A

Got stuck AGAIN behind 2 women on the 405 who had a very minor fender bender. They were out of their cars in the fast lane apparently waiting for CSI and a team of detectives. Annoying as hell during rush hour. Is there a law that says you should move to the shoulder if possible or are these chuckleheads within their rights to block traffic until the CHP gets there?

If they are able to move then they need to move since vehicle stopped on the roadway are a hazard.

Here it is. Straight from the Vehicle Code...................

22400. (a) No person shall drive upon a highway at such a slow
speed as to impede or block the normal and reasonable movement of
traffic unless the reduced speed is necessary for safe operation,
because of a grade, or in compliance with law.
No person shall bring a vehicle to a complete stop upon a highway
so as to impede or block the normal and reasonable movement of
traffic unless the stop is necessary for safe operation or in
compliance with law.

I see this a couple times a week on my commute. The freeway is a scary place to be just standing around on, I don't understand why average folks don't get it.

No medical needed = get off on the shoulder ASAP.

They think if they move the cars, we can't figure out what happened. It is so hard to decide who is at fult when one car is stopped for traffic and the other person is texting/reading/eating/nose mining/chatting on the phone/putting on makeup/having sex/sleeping (pick your choice) while they slam into the back of the other car.

Ok, the guy having sex gets a little slack because.........uh.......hmmm.....at least someone is getting some.

Vehicle code section 20002 applies even though its more for hit and run. It describes the duties of persons involved in collision.

20002. (a) The driver of any vehicle involved in an accident resulting only in damage to any property, including vehicles, shall immediately stop the vehicle at the nearest location that will not impede traffic or otherwise jeopardize the safety of other motorists. Moving the vehicle in accordance with this subdivision does not affect the question of fault. The driver shall also immediately do either of the following:

(1) Locate and notify the owner or person in charge of that property of the name and address of the driver and owner of the vehicle involved and, upon locating the driver of any other vehicle involved or the owner or person in charge of any damaged property, upon being requested, present his or her driver's license, and vehicle registration, to the other driver, property owner, or person in charge of that property. The information presented shall include the current residence address of the driver and of the registered owner. If the registered owner of an involved vehicle is present at the scene, he or she shall also, upon request, present his or her driver's license information, if available, or other valid identification to the other involved parties.

(2) Leave in a conspicuous place on the vehicle or other property damaged a written notice giving the name and address of the driver and of the owner of the vehicle involved and a statement of the circumstances thereof and shall without unnecessary delay notify the police department of the city wherein the collision occurred or, if the collision occurred in unincorporated territory, the local headquarters of the Department of the California Highway Patrol.

(b) Any person who parks a vehicle which, prior to the vehicle again being driven, becomes a runaway vehicle and is involved in an accident resulting in damage to any property, attended or unattended, shall comply with the requirements of this section relating to notification and reporting and shall, upon conviction thereof, be liable to the penalties of this section for failure to comply with the requirements.

(c) Any person failing to comply with all the requirements of this section is guilty of a misdemeanor and, upon conviction thereof, shall be punished by imprisonment in the county jail not exceeding six months, or by a fine not exceeding one thousand dollars ($1,000), or by both that imprisonment and fine.

I hate that too, they jam up the freeway, take it to the shoulder people!

They are almost universally on the phone with their insurance company, mainly out of fear of incurring liability. Had a lady recently who was on the phone with her lawyer, standing on an expressway. I should have told her that her lawyer had to respond to the scene immediately, and stand in the road with her.
