    Retired LAPD not needing CCW?

    My dad is a retired LAPD officer who for many years has carried his pistol at his feet in a bag in his car. He has with him at all times. My mom now has a Domestic violence restraining order against him because he has threatened to hunt her down and kill her many times since there divorce.

    My dad being a retired LAPD says he can Carry legally without a permit and dose on a regular basis (until the domestic violence restraining order was temporally put in place, this expires at the end of the divorce ) I still cant find any info if this is true or not.

    He also frequently has his pistol in his car while at the bar and drives home drunk with it at his feet.

    Yes a retired Officer is issued a retired ID and is allowed to carry a concealed firearm.

        If he is honorably retired, and he has qualified with the weapon within the past five years, and he has an ID card issued by LAPD with the qual dates, yes he can. Otherwise, NO...

          But, if there is a current restraining order on him in effect,I think he may have a problem carrying or even having any firearms in his possesion

            Ya he no longer has them currently due to the restraining order, sorry I should have clarified that. BUT the restraining order expires at the end of the divorce and he may get acquitted from the charge due to the witness not being available. Then if he is acquitted the criminal restraining order is lifted and he is free to carry again and continue harassing my mom.

              I can feel your dad's pain as he's probably gonna lose 50% of his pension to mom. As for the restraining order, that sucks and he better not have any firearms on him during the process.

                Not exactly accurate. If he is honorably retired, he is issued a retired LE identification card. The card will specifically state if he has CCW priviledges and and expiration date for said priviledge. The qual date has no bearing for the state CCW portion. For LEOSA carry priviledges, the qualification portion is ANNUAL and is valid for one year from the qualification date. It's not a traditional CCW permit per se.

                If he is the subject of a restraining order, he can not possess a firearm, regardless of any credentials issued by LAPD.

                I suggest that you send copies of all the restraining orders to LAPD headquarters in Los Angeles, attention to their retirement section. They will revoke any credentials issued until things are resolved. I had an investigation where a retired LAPD officer was harassing his ex wife, who was a deputy working under my command. Once they had all the documentation, he was called in and issued retirement ID without CCW privileges.

                It sounds like someone needs help with an alcohol problem.

                  That sucks? maybe you missed the part where he wants to kill her. Hes an abusive dick. He abused me as a child, would yell and break **** in our house when my moms dinner didnt taste good enough, and constantly cheated on my mom.

                  he used to work DSD gangs, he would go after 3rd strike felons who didnt want to be found, and would brag about how he could find any one. He hates my mom for leaving her now that shes not "fat". He threatened her many times over the phone telling her he would hunt her down and make her pay.

                  My mom who has never held a gun in her life, now went out and bought a handgun. Ive been working with her to shoot it and get her confident with it. So dont "feel sorry" for that prick. He brought this on himself.

                      You definitely need to contact the LAPD retirement unit. They will take action when you provide the documentation.

                      It sounds like both you and your mom have finally drawn that "line in the sand" so to speak. The gloves come off. You need to file a report EVERY TIME he makes a threat. Document every contact. If he violates the current order, make a police report, every time. You must be consistent.

                      When the divorce is final, with sufficient cause, the judge can grant a permanent restraining order. Sometimes they are good for three or five years, renewable with proper cause.

                      I was forced to work with some cops like this over the years. They tarnish the badge and have no place in the brotherhood. He has the ability to just let things be, accept the fact that the relationship is over, but no, he is a control freak. He has made his bed, now he must lie in it.

                        You did ask me and sorry for all that's involved. The one point for me is my retirement and I refuse to let anyone take it from me.

                        Like the other poster wrote, you put yourself out there and shared half of the information. Ease up buddy.

                          California is a community property state, so she may be entitled to a percentage of his retirement based on the length of the marriage.

                          If a court determined your ex wife was going to get half of your retirement, are you advocating committing the crimes of stalking and terrorist threats in that case? Ease up, buddy.
