    Illegal ar 15s??

I went to the desert to go shooting with a buddy from work. I drove. Should've asked what he was bringing but didn't think to. We got out to the desert and he breaks out his ar15. No bullet button. And he had several 30 round mags for it.

Needless to say I won't be shooting with him anymore, but I was wondering the punishment and any scenarios that could have happened if we would have gotten stopped. Going through the border patrol check point really had me nervous.

Would he have gone to jail? Had to give up his AR?

Well did you bother to ask if it was a Registered Assault Weapon, or just assume the people you hang out with are criminals?

Seriuosly, not all AR's require BB, and some people did own the rifles and mags before the current flock.

If he was your buddy why did you not help him out a bit and explain the laws to him. Simply breaking the rifle down would be enough to help.

It was pretty new. Not pre ban. I don't know all the laws either that's why I was asking here. So if we break the ar down ( removing the upper from the lower) then it becomes okay?? I need help...

No. Had a buck head on it, if that's what you mean by featureless. Maybe I should re ask the question.

If you pulled someone over and they had an ar 15 with no bullet button and a hand full of 30 round mags, assuming its not a registered assault rifle, and was purchased after the ban.... What kind of trouble are you looking at?

"Wobbler" sentencing for possessing assault weapons

Possession of assault weapons is what’s known as a wobber. When an offense is a "wobbler" it means that prosecutors can choose to charge you with the crime as either a misdemeanor or a felony, depending on the facts of the case, and your criminal history. If convicted of misdemeanor possession of an assault weapon, you face up to one year in a county jail and a maximum $1,000 fine. If convicted of felony possession of an assault weapon, you face 16 months, or two or three years in the state prison and a maximum $10,000 fine.26

It's a lengthy penal code, with up to 43 definitions if you read on the law firms website is broken down easier. But as others stated, the only exceptions are if you had in your possession before the ban date , are in the military with a permit, or is active law enforcement, or in entertainment. All require registration.

Charged with manufacturing, selling, or transporting an assault weapon under PC 30600? Our CA defense attorneys explain the law, penalties, and your defenses.

                    "Featureless" = no evil features.
If a semi auto centerfire rifle does not have any "evil features" like a pistol grip, flash hider, folding or collapsing stock or grenade launcher, it can have a detachable magazine (no mag lock) and has the ability to accept and use any legally owned magazine.

If this was the rifle, you're looking at no trouble at all:

Can you be more specific as to how the rifle was configured? If it was RAW or Featureless then no problem.

Featureless you can spot pretty easily. RAW is a bit harder to spot.

You mean it was a Stag AR ? If it is then it's probably not preban.

you both would have been detained for questioning. he would have been arrested for a felony and had his weapons and hicap mags taken. you could have gotten some charges depending on the cop and what you knew before you transported. you could also get a felony conspiracy charge if you knew about it and went anyway. know your laws, especially when it comes to guns. You're ASSuming a lot here. Many of us own OLL without mag locks and legally run our +10 round mags in them. Until the OP makes it clear that it really was an illegally configured weapon, there is no way of knowing.
