    Question About a Video



    I support the officer's decision to give this kid what he deserved and I would have been laughing at the kid if I was there. But, I was wondering if there are any laws pertaining to using verbal or sign language profanities towards an officer.

      I wish my baton worked that well. The video looks like a fake. But, for the OP, that kid's actions could be construed as assaultive behavior if the officer believed he was in danger.

        I believe you can say anything to cop but with two exceptions:

        1) you should not personally threat physical harm to the officer

        2) you should not personally threat death to the officer

        These two fall under 422PC....especially if the threat is deemed credible. Sloppy drunken verbage don't really count...but I wouldn't test it.

          See PC 69, all peace officers are officers under the executive branch:

          69. Every person who attempts, by means of any threat or violence,
          to deter or prevent an executive officer from performing any duty

            You're correct! 422 is nore applicable for non-LEO victims.

              Real or not, after behavior of that sort, as soon as the kid turned his back and I couldn't see his hands, I would have done the same thing. Then again the kid flipping off a cop and "going into his personal space" isn't a good idea either. It's a judgement call at that point, but if it were real, not a good thing to do.
