Right Turn Lane Question...

    Right Turn Lane Question...

    This bugs me to no end and I just want to make sure I got it right. I have a four way intersection in my city. The direction of travel that concerns me has a straight/left turn lane and a right turn only lane. Oncoming to that is a straight/left and a straight/right turn lane. This is controlled by a circular green light (no arrow). In this situation, the right of way goes to the right turn lane before oncoming left turns doesn't it?

    It seems like people in the oncoming left turn always cut me off at that intersection, or I get behind somebody in the right turn lane that waits for everyone turning left to go before they do. Drives me up the wall.

    I am not a LEO but I think you are right. CVC 21801 (a) says anyone making a left turn or u-turn must yield right-of-way to all approaching vehicles from opposite direciton that are close enough to be a hazard.

    21801. (a) The driver of a vehicle intending to turn to the left or to complete a U-turn upon a highway, or to turn left into public or private property, or an alley, shall yield the right-of-way to all vehicles approaching from the opposite direction which are close enough to constitute a hazard at any time during the turning movement, and shall continue to yield the right-of-way to the approaching vehicles until the left turn or U-turn can be made with reasonable safety.

      This is my understanding as well. Excepted only when that left turn has the green arrow, which would give the right turn lane a red light, thus making right turn yield to the left turning vehicle before making a right on red (where legal).

        Yes because in that case CVC 21453 (b) would apply to the person making a right turn.

          Which should have signage. Under VC 22101(d) if so VC 21453(b) and (c) would come into play.

          Right turn, you must turn in the right most lane.

          Left turn you can turn in to any lane unless lane lines are present (A multi-left turn).

          Doesn't hurt to brush up on the DMV Handbook some people really need to...

            Agreed. But if the right turn had a red light, it doesn't matter which lane they were going into, they HAVE to yield to the Left turning vehicle. Which means sitting there stopped until all left turning traffic has completed the turn before making theirs.
            If I misunderstood what you were getting at, then ignore this.

              If you (turning right) have a green light at the same time as the people turning left, they have to yield to you. However, I believe, you are only allowed to turn into the right most lane. If the road both you and the people turning left towards you are turning onto is multi-lane, you have to take the right most lane and it should be safe for the people turning left to take any lane left of the right most lane.
