    Parking lots

    Out of sheer curiosity, can someone be cited for blowing through a stop in parking lot?

    More specifically the ones where STOP is just painted on the pavement with a limit line, but no actual stop sign posted?

    Yes, you can. Stop signs are valid in parking lots, just as well as on streets. If you are seen by a LEO blowing a stop sign in a parking lot, expect to get ticketed the same.

      Please read below:

      V C Section 21107.8 Private Parking Facilities

      Private Parking Facilities

      21107.8. (a) Any city or county may, by ordinance or resolution, find and declare that there are privately owned and maintained offstreet parking facilities as described in the ordinance or resolution within the city or county that are generally held open for use of the public for purposes of vehicular parking. Upon enactment by a city or county of the ordinance or resolution, Sections 22350, 23103, and 23109 and the provisions of Division 16.5 (commencing with Section 38000) shall apply to privately owned and maintained offstreet parking facilities, except as provided in subdivision (b).

      (b) Notwithstanding the provisions of subdivision (a), no ordinance or resolution enacted thereunder shall apply to any offstreet parking facility described therein unless the owner or operator has caused to be posted in a conspicuous place at each entrance to that offstreet parking facility a notice not less than 17 by 22 inches in size with lettering not less than one inch in height, to the effect that the offstreet parking facility is subject to public traffic regulations and control.

      (c) No ordinance or resolution shall be enacted under subdivision (a) without a public hearing thereon and 10 days prior written notice to the owner and operator of the privately owned and maintained offstreet parking facility involved.

      (d) Section 22507.8 may be enforced without enactment of an ordinance or resolution as required under subdivision (a) or the posting of a notice at each entrance to the offstreet parking facility as required under subdivision (b).

      (e) The department shall not be required to provide patrol or enforce any provisions of this code on any privately owned and maintained offstreet parking facility subject to the provisions of this code under this section except those provisions applicable to private property other than by action under this section.

        depends on the parking lot and jurisdiction. Most are enforcable, but not all.

          In the city I work- no. In the city I live yes. The signs are posted though that says all CVC's enforced though in those lots.

          Of course if you blow a stop sign in the lot, you're probably going to be at fault in a crash no matter who put the stop sign in.

            where I work - CVC sections are not enforced in parking lots.. Except for the usual reckless/DUI/etc sections that apply to parking lots accessible to the public... Collision reports are not even taken if they occured in parking lots, unless there is an injury... So, in essence, the stop signs in parking lots are "suggestions," and not regulated.. YMMV.

              Not true in all cases. In the area I used to work in regards to private property, the only two Motor Vehicle Code sections we were allowed to enforce were expired registration and DUI. Parking lots are private property accessible to the public. There's a bunch of hoopla to go thru for LE to be able to enforce the CVC on them.

                Only if there are signs posting that all CVC will be enforced on private property. Then you have the semi-public facilities like schools and colleges which have all laws enforceable via CVC21113.

                  if there is no actual stop sign posted, but just the word stop painted on the ground in a parking lot...... does that make a difference?

                    As previously posted, it all depends. If you don't see any signs posted saying that CVC is enforceable and you don't see Officer Friendly, then it becomes a judgement call. Course the way people drive in parking lots now-a-days, I'd stop just to ensure someone else doesn't blow thru it and T-bone you.

                      i wonder this as well, because sometimes parking lot stop signs are very tempting to blow through.
