The windows on our vehicles that have tint on them were done when we lived in a state that allows it. We brought those vehicles to this state when we moved. CA DMV inspected those vehicles and accepted them as is. I contend that by accepting our money and issuing a registration, they were in deed confirming that the vehicle is acceptable in this state.

Doubt that I have a leg to stand on, but if the state acted in good faith, that is the way it should be!

DMV inspects your vehicle for presence of smog equipment and certain safety equipment, like lights. If it's there, you're okay ... for now. After 2 years, you'll have to get it smog-tested. They don't inspect anything else.

In SLO county, you have to take yourself and your vehicle to DMV to register it since it is an out of state vehicle. A DMV representative comes outside and inspects the vehicle to include opening the hood.

If a DMV representative physically inspects the vehicle and attests that it meets CA requirements, then I don't think they should be able to come back later and penalize me for the same thing they accepted earlier.

Smog: they have you go to a 3rd party and get tested. A DMV rep doesn't sniff your tailpipe outside the building.

I heard the other day at the court that if you get ticketed for the tinted window again, the penalty will be very high, even though it is a fixer ticket. I am not working traffic, and I am not sure about it.

DMV wouldn't know an EGR valve if it bit them in the ars.

Window tint on the drivers window sucks and it's not legal here, regardless of when/where it was put on.
Cops want to see what you are doing when they walk up to the drivers window when they pull you over...think about it.

When I'm riding my bike I want to see if you are looking at me and see me or if you have your phone up side your head and are about to pull out in front of me.

Stupid punky/criminal stuff that drivers window tint says me.

with or without tint, in pouring rain, i put down all my windows and at night i turn on the dome light.

the stupid punk/criminal comment is referred to as 'jaded' me thinks
is it not legal because of law, or because its not liked? just curious

I much prefer LEO's have the tools available to them to make a stop when they feel necessary, but if cops are stopping drivers just for the window tint, i think they are really pushing it and wasting my tax paying dollar. stopping for tint to hopefully find something else to really support further detention i'm ok with, but if a cop stops and tickets 'just' for tint, thats unacceptable.

anytime i've been pulled over for tint, they approach the car, say something about the tint, we talk a bit, and they say have a nice day.

Can I put after-market tinting on the windows of my vehicle?
The main requirements for legal window tinting in California are:

                    1. The windshield and front driver's side and passenger's side windows cannot receive any aftermarket tinting.
                    2. If the rear window of a vehicle is tinted, the vehicle must have outside rearview mirrors on both sides.

The law prohibits any person from driving any motor vehicle with any object or material placed, displayed, installed, affixed, or applied upon the windshield or side or rear windows, with certain limited exceptions.

However, legislation signed into law effective January 1, 1999, exempts from the above prohibition specified clear, colorless, and transparent material that is installed, affixed, or applied to the front driver and passenger side windows for the specific purpose of reducing ultraviolet rays. If, as, or when this material becomes torn, bubbled or otherwise worn, it must be removed or replaced.
clear, colorless, and transparent material = No Tint.

its hard on LEO, unless they have an actual piece of test equipment, been through that one myself, on a factory tint job (smoked glass). its impossible for an officer to claim they can tell its tinted xx%, that would be pretty much lying. I used to have it from CHP FAQ, that tinting was not illegal. couldnt find it last i looked though.

I used the Laser Labs Model 100, so I didn't have to lie on the citations I wrote. http://www.laser-labs.com/products.php

Even with a Doctor's note, you cannot permanently tint the windows. With the note, You would be allowed to use removable tint, shade or louvers to block you from the sun, but they have to be removed during darkness.

I take it that your vast amount of law enforcement experience enables you to dictate what is acceptable for law enforcement to do?

For the O/P, there's a thread which I posted information on CVC tinting laws.
It's a few pages, but if you skim through, my posts have factual information you may find helpful.

                            acceptable to me, the public.
umm, yah, i think i can decide whats acceptable to me
I'm simply passing along my experience, observations and opinions, what you do with them is up to you.
i havent dictated anything, i simply stated that I find it unacceptable for an officer to waste MY tax paying dollars to ticket someone for something as frivolous as window tinting.

I'd hope that officers dont use that as sole probable cause for anything serious. oh, I guess nobody has ever seen window tint being rejected as probable cause, try it sometime, and let me know how that works out.

I also suggested that I do uphold that officers should have tools available to them that help, because I do think we/the public tie the hands a bit.
