    shooting off list wepons

    A friend of mine from georgia was out here during the holidays for a wild boar hunt, his choice of gun was the sig P226 Tac Ops .40 ( this is a off list gun ) He left his gun for me to try at my local range, I want too make sure I'm not breaking any laws by doing so.

    It shall be unlawful
    (5) for any person (other than a licensed importer, licensed manufacturer, licensed dealer, or licensed collector) to transfer, sell, trade, give, transport, or deliver any firearm to any person (other than a licensed importer, licensed manufacturer, licensed dealer, or licensed collector) who the transferor knows or has reasonable cause to believe does not reside in (or if the person is a corporation or other business entity, does not maintain a place of business in) the State in which the transferor resides; except that this paragraph shall not apply to
    (A) the transfer, transportation, or delivery of a firearm made to carry out a bequest of a firearm to, or an acquisition by intestate succession of a firearm by, a person who is permitted to acquire or possess a firearm under the laws of the State of his residence, and
    (B) the loan or rental of a firearm to any person for temporary use for lawful sporting purposes;

      Okay, while the manner in which you possess the gun may be questionable, it is perfectly legal to own and shoot an off roster handgun in California.
      I'm not saying you're breaking a law, but the way you posted about you friend from out of state is confusing.
      Never initiate force against another. That should be the underlying principle of your life. But should someone do violence to you, retaliate without hesitation, without reservation, without quarter, until you are sure that he will never wish to harm - or never be capable of harming - you or yours again.

        Thank you for the feedback, as a newbie let me clarify, this gun is registerd to an out of state individual (my friend) he left his weapon for me to demo, it is his gun in my care, there is no transfer anticipated.

          Anyway, off-roster guns are not illegal. You should NOT have any magazines that hold more than 10 rounds.

                    Off list guns are only prohibited for NEW transfers. You can have them all day long if they are properly transferred via PPT or loaned by the owner for less than 30 days.

                    Not sure about the out of state thing though... but I don't see why someone can't lend you a gun if it is otherwise legal for him to have... and it is not prohibited for him to bring the firearm (non-AW) into the state, just the 12 round magazines.
