    3 strikes window tint

    My sister got a fix-it ticket the other day for window tint. She was told that their is now a 3 strikes law for window tint with the second ticket being a $350 fine and the third offense your vehicle getting impounded and the driver going to jail. This seems awfully harsh to me. Any truth to it? Thanks

      Its harsh but then again, everyone knows its against the law. If you keep doing it again and again
      Not saying its rights and I like the idea of women being able to have it to keep creepy guys from looking in and targeting them but I remember window tinting from my DMV handbook from 13 years ago.

            Seriously, jail and impound? Not going to happen for window tint. You can get cited over and over again, and the judge can increase the fine on subsequent violations. You can also be cited for "Unlawful Operation After Notice by a Peace Officer" which is not a fixit ticket.

                    If you are arrested for a misdemeanor, you can be taken in for booking and your car impounded persuant to the arrest. This code requires three convictions in 12 months but they do not have to be for the same violation.

                    40000.28. CVC Any offense which would otherwise be an infraction is a
                    misdemeanor if a defendant has been convicted of three or more
                    violations of this code or any local ordinance adopted pursuant to
                    this code within the 12-month period immediately preceding the
                    commission of the offense and such prior convictions are admitted by
                    the defendant or alleged in the accusatory pleading. For this
                    purpose, a bail forfeiture shall be deemed to be a conviction of the
                    offense charged. This section shall have no application to violations by
                    pedestrians.

                      Actually your vehicle will be stored per 22651(H) if you were arrested, not impounded. Impounds are 30 day holds and are usually used for 12500(A)VC - Driving without a license / 14601VC - Driving on a suspended license violations. There are other reasons to impound as well, although this violation does not warrant a 30 day. You will be able to pick up your stored vehicle at your earliest convenience, although there will be a small fine to pay the LE agency, as well as the tow yard (nowhere close to an impound fee.) A gate fee will likely be required if the tow yard is not open for business at the time you wish to pick up your vehicle.

                          So, re: posts 10 and 11, would you guys know in the field that someone had previously been cited more than once for something? Would you even bother to check if he had been previously cited for windowing tinting or just cite him and kick him loose?

                            Yep, neglect of the correctable violations becomes a misdemeanor and u can go to jail. So beware.

                              i paid about dozen of them on single car within 2 years timeframe. i never took the tint off.
