If the gun is in the evidence storage, it will show up in AFS as an evidence. I don't think you can do a voluntary registration for a gun that is in evidence already.

^^^This^^^ it would have to be cleared from evidence status in AFS before it could be registered, as I recall my training. And to get that to happen would require a LEGR if it's to be cleared back to the owner. Basic Catch 22 right there if true.

Remember the firearm must be available. That means it's not held as evidence in a pending case or needed in some other way.

Actually, I have frequent requests from the detectives to rush the firearms examination, so they can return the firearms to the owner. I don't know the circumstances of the cases, but the guns are being returned to the owners. Obliterated serial numbers of some guns are restored. And, if the serial numbers are verified, the guns are returned with original serial number re-stampted and documented. I have done this myself several times at the office.
