Gents,

Quick question. In your experience, what are the chances of getting a citation dismissed if the LEO miswrote the CVC on the citation?

For example, say you violated a certain section of the vehicle code. If the officer miswrote the CVC number, but wrote the actual violation in text, would that be dismissable?

It won't be dismissed, they will just send out a correction notice when the mistake is found.

exactly. Even on parking tickets, you can mark the completely wrong thing and they'll just send a correction notice.

What if you don't send a correction notice, like if the officer didn't catch it and it goes to court like that?

I have even seen a citation correction done in front of the judge. The Officer just amended it in court before testifying.

In California they do not go by the number of the offense but the description. Kind of like if I wrote you a check for $100. but the text said ten dollars, it's the written part that counts.

I found this out because I had an arrest decades ago and when my lawyer researched it, the penal code number entry itself was not a crime. They used the wrong subsection. But the offense that was written out can be found under another section, and that's what counted.

In some states you can walk when there is such an error, but CA is not one of them.
