Was target shooting near Gilman springs road and recieved a OHV ticket for driving my truck on private property. Is there any way to successfully fight this ticket?

There is a way. Case dismissed as of 2-4-11. Thank you, hello to saving $250. To bad I could not get any good feed back from here...

Issuing agency? Private property posted? Complaint by property owner or on viewed by LEO?

Need a lot more facts for any kind of an understanding.

The issuing agency was Riverside county sheriff. No signs are posted at all from 60 freeway all the way to where we turn off. Which is about 2-3 miles approx. The LEO's showed up to patrol. If you know the area it's open wilderness. Nothing indicating ownership.

There are a lot of signs posted there. Usually on the phone poles. It's not 'wilderness area' it is private property and people have been getting cited there for years.

Also, it is prohibited by county ordinance to shoot there, so you were lucky you didn't get cited for that and lose your guns.

Pretty much in SoCal unless you are on BLM or NF land, you are on private property.

Add the fact that the area is a high fire danger right now, you were in the wrong place to be shooting and driving off road.

If it's not BLM land or NF land (it's neither) it is someone else's land so common sense and courtesy should tell you to stay the heck out. Just because "everyone does it" or "you have been doing it for years" that doesn't make it legal.

You got lucky and won on a technicality. You were still trespassing ON SOMEONE ELSE'S PROPERTY. Like I said before, if it is not BLM or NF land, and you don't own it, it belongs to someone else. How would you like it if someone drove across your front yard because there was no sign visible.

I drive Gilman Springs all the time, and I see no trespassing signs all the time. You don't seem to get it, nor do you appear to have any respect for other people's property.

I wouldn't recommend coming in to the LE forum and expect too many LEOs to agree with you.

Nothing implied. Just have some respect for the law abiding folks that pay your bills. A warning does wonders for people like me.

I was not there acting like an idiot. Just teaching the kids how to shoot better than LEO's But really, if it were marked I would avoid the area like cancer. All Im saying is the county should have property owners secure their property before spending tax payer dollars to do so. Like I said, if it isn't your property, BLM land, or NF land, it belongs to SOMEONE ELSE, not you, so you don't belong there. A little common sense goes a long way.

I dunno Ron....you've said that, what, three, four times now? Maybe thats why he got a ticket instead of a warning; because he clearly doesn't get it or listen.

This isn't 1884...there is no free range any more. If you don't hold the title to the property, its not yours land. If its not your land, you don't have the right to be there. I think my kids would even get that on the first explanation.
