Question about home intruders..

A buddy of mine told me that his neighbor caught someone in the act of breaking into his home with a "gun" on his front pocket.. He smacked him with a golf club and broke his wrist. Guess who was held liable?? And the gun was actually not an actual gun but a toy.

In the case that someone does break into my house, and "I am in fear of my life" and I choose to defend myself with my .44 Mag instead of one of my many lower caliber guns, does this become an issue?
