LEOSA Improvement act HELP NEEDED

The U.S. Senate passed S. 1132 and the house companion bill H 3752 is awaiting action.

The bill does the following:

•Clarify the status of Amtrak Police and other federal officers
•Grant LEOSA carry rights to current and retired law enforcement officers (with civilian arrest powers) who work or have worked for a branch of the United States Armed Forces.
•Reduce the amount of time that an officer has to serve as an officer from 15 years to 10 years to qualify for LEOSA carry rights
•Create a procedure for retired officers to meet the requirements necessary for LEOSA carry

It also exempts LESOA folks from the federal gun free schools act. It also allows people to qualify with any department in the state instead of insisting on a state standard. CA, MT, WY, MO, LA, NY, MT, AK and WI do not have a state standard so retired LEO's in these states will not be able to qualify with any PD in the state.

NOTE: THE BIGGEST THING

It federally preempts ammo restrictions so places like New Jersey can no longer ban LEOSA people from carrying hollowpoint ammo.

The bill is missing one thing and I need your help on that. The bill does not address magazine limits. CA as well as NY, HI, MA, and NJ have magazine restrictions. I contacted Congressman Forbes (R-VA) office as he is the sponsor of the house bill. His staff was very interested in what I had to say about the magazine issue.

PLEASE contact his office and express that you would like to see an amendment to his bill to exempt "magazines and other feeding devices that are not prohibited by federal law".

This bill will probably pass the house and become law as it has overwhelming support and it is very possible to get the magazine preemption inserted into the bill. All it takes is a 2 minute phone call to his office.

Please do this. It appears the lack of magazine preemption was an oversight, please call and insist on an amendment to fix this. The Senate should concur with the amendment since S 1132 passed the senate with no issues and no votes against it.

Naturally, I would like to see all restrictions on the RKBA removed; however, in the immediate present time, we can at least make a huge improvement for LEO's. LEO's have been threatened to be jammed up in NJ for magazines that hold over 15 rounds and hollowpoints.

Usually when you call an office they act polite and say thank you and you get a generic letter in the mail.

When I called, the man I spoke with sounded very serious and I think they really overlooked this and they will fix it if enough people call. They asked for my number and he asked if it was ok if they called me back if they had more questions.

If you are a member of any police forum or FOP or whatever, please post my message there as well.

I gave the example that most agencies issue standard capacity magazines and if they were to vacation in Hawaii, New Jersey, they just committed a felony.

The same may be able to be said about California.

Under this cleanup legislation won't retired officers in these states be able to qualify with any PD in the state?

This legislation is very important to retired peace officers.

sorry if I was confusing, the bill would allow you to qualify with any PD in your state of residence if there is no state standard.

If you do call please ask that they also add magazines and feeding devices to the definition of firearms as they did with ammo. This would solve high cap mag issues (at least for LEOSA folks).

I didn't realize how fortunate I am after reading Retriever Believer. I just have to call the range, make an appt. and come down to shoot. IIRC, I pay for the ammo they provide (lead free), shoot and I'm done until the next year. Same thing for the county one that is good for 5yrs.

I have both, because as I said above, I tend to forget about the LEOSA one and I forget to renew it.

Are there any differences between the House & Senate versions? AS the bill passed the Senate by unanimous consent it's not likely there would be a need for a conference committee. Better to get the changes in the House bill before it goes to the floor for a vote.

Socalblue, I am not aware of any differences but that is why it is urgent to change the house version via amendment before it is passed and heard by the full house. I see no reason why the senate would not go along with the magazine amendment, please call Rep. Forbes' office tomorrow and insist that magazines and feeding devices be included in the definition of firearms as they did with ammo. The magazine issue is very important and it will be reality if LEO's start calling. Please tell your LEO buddies to call, it takes 2 minutes.

Just make sure they word it right so "importing" and such are all covered. If they overlooked it, they might not know enough to avoid botching it if they amend in a hurry.
