I used discretion all the time... but generally not where felonies were concerned. That has a tendency to come back and bite you in the backside eventually. My point above, and assuming only that the situation was exactly as the OP theorized, was that it could have been an easy felony arrest.

Particularly in a border county, or close to one anyone anyway, I think I'd be pretty circumspect about a guy from the neighboring state who was otherwise cool and was committing that type of a violation. He doesn't live here, he doesn't know goes the logic. If he's cool then maybe so. If it was a RAW of someone who lives here, then king's X, have a great time fellas, and I'm gone.

But if it was as the OP theorized, and I did shine it on, I'd also make very sure he was fully educated about our laws before I left and tell him firmly to get himself and his rifle back across the state line before one of my partners without my sense of humor came rolling by.

What part of the county was it? If it was the east county back country, those guys have much better things to do than drive an hour each way to take someone in on a technical gun charge.

If you can without screwing yourself, advise him IMMEDIATELY disassemble the rifle (split lower/upper) before he travels back out...

was it the mags that was a problem or the rifle??

If it was the rifle I can see the problem....but if not....it becomes a technical question I think.

perhaps they thought with the pending lawsuits that arresting someone from out of state who may or may not have known better would just cost them time and money they dont have, and wouldn't be justifiable. or perhaps the cops were just cool. not all cops are tacticool, dog shooting a-holes.

you're right though. with the features you said he had, he shouldn't have been running +10 magazines and he'd need to have some kind of mag lock.

....kinda a kin to taking your keys out of the ignition and placing them on the dash when getting pulled over....puts everyone at ease.

I do that........I also told the CHP my wallet was in my cargo pocket on my leg (I was wearing work pants)...he let me get off with a warning...not cause of the keys....but I'm sure it put a + mark in my column.
