Release from jail with outstanding warrant?

    Exactly. I stopped counting how many $25,000 LA County warrants were cited out.

    Being a smaller agency, our policy mandates us to pick up each and every warrant. All those trips to Parker Center to pick up 12500 / 14601 warrants.

      There are several different answers regarding the question, and I would have to say they are all correct. We've picked a suspect up on a warrant from Kern Countly while in L.A. County. We usually make a courtesy call and ask if they are interested. Sometimes yes, sometimes no, sometimes we will meet at the halfway point. This is usually done between stations. Most of the time on something small, it will just be a cite and release.

        We can't take em if they don't have at least $25k in LA County bail. And the only ones that we truly will take on a regular basis in OC is bench warrants or anything felony.

        Otherwise it's just ANOTHER cite for them, which they will probably FTA on anyway.

          I never understood the purpose of citing and release on a warrant. I've never done it, and wouldn't even know how. Everyone goes to jail in San Diego. We can book on even "infraction warrants." They put warrants out here for not having tags on your doggie (bail is $5k).

          They recently stopped making DUI's here book and release. They even have to bail out.

          The only thing we can not book on is out of county misdemeanor warrants, even if the county will extradite.

            I can remember booking a guy on an $18.50 jaywalking warrant once, and he couldn't make bail. It was one of those "attitude" arrests that occur occasionally. He kept dodging questions with questions and the "Warrant Gods" came through for me. That was on Friday afternoon, and Monday was a court holiday. He sure showed me.

              That's good that San Diego handles things that way. Overcrowding and budget problems is the reason listed for not doing it that way in L.A. The only reason to cite out a warrant (even thought it will probably be another FTA) is the bail will go up and eventually they will get booked and be forced to clear it all up.

                All correctional facilities have their own policies on what types of warrants they will hold prisoners on and which they will release on own recognizance. Your only two options would be that once your done in the current county your in, they would have 5 days to transport you to LA county to be arraigned on your new charge/warrant. Option 2 is that they would release you from custody and make you sign a promise to appear, and assign you a court date in LA county.

                  Nobody likes it, but with 20K prisoners in the LA Co system it's all about $$$$ and space.

                      Naw, but when I originally stopped him, I intended to give him a warning. He kept running his mouth and answering questions with questions and dodging simple questions with non-answers. He talked himself to jail. He was the "Karma" poster child.

                        Ron, BTDT. I was trying to make a reference to the whole lie to the police if you have legal guns in the car thing. Lying to me makes my spidey sense tingle and will make me dig deeper.

                            To the original poster,

                            they will not hold you for the LA warrant if LA refuses to place a hold on you. if it is a felony warrant you will be held no matter what. the dollar amount does not necesarily play a role. the "person" in the scenario was probably advised of the out-of-county warrant. LA was probably advised that the "person" being released had a warrant out of LA. LA did not place a hold most likely because it was a non-violent misdemeanor warrant. then the "person" walked with the current san bern county warrant cleared, but the LA warrant active. this person will need to go to an LA court house to clear the warrant.

                              IIRC, the issuing county has 5 days to come and get him. 5 days calendar days if they are under a certain distance(I cannot remember the distance as this time), and 5 business days if they are over that distance. If they fail to do that, and there is no other holds on the subject, he can be released by the county holding him. However, there is still an outstanding warrent from him.
                              The issuing county may request that the county holding him cite him to the issuing county, but that does not always happen.
