    LEO Question

    I'm relatively new to gun collecting in CA, so please excuse the question if its stupid.

    Is a state/federal LEO required to provide a letter from his/her agency to purchase a non-rostered handgun? How about from an out of state FFL?

    Me again, the FFL in CA can order any gun for LEO's just can't sell them to civilians.

      Usually a place that sells a "non-rostered"/"un-safe" handgun will get a copy of your police ID to cover their back-side.

      You have to follow the laws for the state that you live in. Hence, if you buy something from out of state, they would have to send it to your FFL in your state and then do the DROS.

      Yes shops will not sell non-rostered firearms to non-LEOs.

      But you can buy and transfer a non-rosterd firearm from someone who owns it to you through your FFL.

        No. If they want the 10 day wait waived, a letter is required expressly for that.

        How about from an out of state FFL?
        Assuming an out of state seller willing to ship to California, gun ships to local CA FFL, who then DROS to the LEO. Ten days later, LEO takes delivery.

          Sweet Jesus, this is crazy-nuts stuff.

          So, if I'm a Fed LEO, I can order a NIB Colt Delta Elite 10mm (not on the approved list) and take possession of it after the 10 day waiting period with no letter from my employer and its totally legit?!?!

          I'm just confused as hell. Sorry.

            Policy Change Regarding State Exemptions for Authorized Peace Officers

            Effective immediately, peace officers who have legislative authority to carry and use firearms may, without a letter signed by the head of their agency or the agency head's designee, purchase non-rostered handguns and/or large capacity magazines. The peace officer must present a valid peace officer identification card and the dealer must retain a copy of the identification card on file. (PC 12132 & 12133). A letter is still required from the head of the agency to exempt the peace officer from the ten day waiting period. (PC 12078).

              That pretty much sums it up, as LEO you are exempt from the roster and no letter is required. Most of the shops I have done business with have made a copy of my LE ID for their records.

              You can transfer any non-roster (and otherwise legal) handgun between two private parties in a FTF deal. That does not require LEO exemption.

                yup... I just bought a Sig p238, without a department letter, and all they did was copy my police ID. I still wait the 10 days like everyone else. Had I known I was going to buy the gun, I would have gotten a letter to waive the 10 day period. spur of the moment purchase

                ah well.. gives me a reason to go back "home".
